HomeMy WebLinkAbout97-093Resolution No. 97- q ~ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND AUTHORIZING THE MAYOR TO SIGN A LICENSE AGREEMENT WITH PENEE D'AMICO FOR USE OF A PUBLIC RIGHT-OF-WAY The City Council of the City of Port Townsend, Washington, resolves as foUows: WHEREAS, the City has agreed to enter into a License Agreement because the portion of the fight-of-way at issue is needed for the temporary storage of a historic structure, which would otherwise be demolished; and WHEREAS, the License Agreement is revocable at will by the City; and WHEREAS, the Building and Community Development Department (BCD) has discussed the proposed use of the right-of-way with a representative of the abutting landowner (St. Paul's Episcopal Church), who has indicated and agreed that representatives of the church do not object to the proposed use of the public right-of-way; and WHEREAS, the proposed use will not obstruct pedestrian or vehicle access on the right- of-way or will not materially interfere with the normal public use of the right-of-way; and NOW, THEREFORE, BE IT RF~OLVED, by the City Council for the City of Port Townsend that the Mayor is authorized to sign a License Agreement with Penee D'Amico for use of the Jefferson Street public right-of-way in substantially the same form as attached. ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor on this 4th day of August, 1997.
