RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
EXTENDING THE EXPIRATION DATE FOR RESOLUTION NO. 97-92,
IMPOSING A MORATORIUM UPON APPLICATION ACCEPTANCE AND
CONSIDERATION OF STREET VACATION APPLICATIONS
The City Council of the City of Port Townsend, Washington, resolves as follows:
WHEREAS, at the regularly scheduled August 4, 1997 City Council meeting, the Port
Townsend City Council adopted Resolution No. 97-92, suspending review and consideration
of street vacation applications pending adoption of the Comprehensive Nonmotorized Plan, and
imposing a moratorium upon acceptance and consideration of street vacation applications; and
WHEREAS, in Resolution No. 97-92, the City Council adopted a number of
legislative Findings supporting the moratorium action. Said Findings are reaffirmed and
incorporated herein by this reference; and
WHEREAS, in Resolution No. 97-92, the City Council provided that the moratorium
action would expire on January 1, 1998, or upon the City Council's adoption of the
Comprehensive Nonmotorized Plan, whichever date first occurs. However, the City Council
retained its discretion to extend the applicability of the Resolution after January 1, 1998, "in
the event the Comprehensive Nonmotorized Plan is not adopted on or before that date"; and
WHEREAS, the Comprehensive Nonmotorized Plan has not yet been adopted by the
Port Townsend City Council. Said Plan has recently been submitted to the Port Townsend
Planning Commission to commence its review. The City Council does not anticipate formal
adoption of the Plan until conclusion of environmental review and a public comment and
public hearing process, and final action by the City Council. It is anticipated that final
adoption will not occur until at least April, 1998,
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port
Townsend as follows:
1. The City Council reaffirms its decision, set forth in Resolution 97-92, to not accept or
process any applications for street vacations pending adoption of the Port Townsend
Comprehensive Nonmotorized Plan. The primary reason for this action is to preserve all
options for nonmotorized circulation within Port Townsend, until completion of all necessary
planning studies with regard to street rights-of-way which may need to be preserved and
precluded from any future street vacation action.
2. In accordance with the legislative findings set forth in Resolution 97-92, paragraph 4 of
said resolution is amended as follows:
4. This resolution is remedial in nature and shall be retroactive from
July 22, 1997 and shall expire upon final adoption by the Port Townsend City
Council of the Comprehensive Nonmotorized Plan (including expiration of any
appeal periods), or jaiiuary I, 199g Iuly._L_199~, whichever first occurs. The
City Council retains its discretion to extend the applicability of this resolution
after jaiiuary I, 199g ~, in the event the Comprehensive
Nonmotorized Plan is not adopted on or before that date.
ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor
on this 5th day of January 1998.
