HomeMy WebLinkAbout98-025Resolution No. 98- 0~ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND AUTHORIZING THE MAYOR TO EXECUTE A FIRST AMENDMENT TO WATER CONTRACT (GLEN COVE SERVICE AREA) WITH JEFFERSON COUNTY PUBLIC UTILITY DISTRICT 1, PROVIDING ADDITIONAL CITY WATER TO THE GLEN COVE SERVICE AREA, TERMINATING JANUARY 1, 2000 The City Council of the City of Port Townsend, Washington, does resolve as follows: WHEREAS, the City owns and operates a system for the supply, transmission and distribution of water and is authorized to sell water which is surplus to the capacity needed to serve the long-term needs of City residents, to other persons and entities outside the corporate limits of the City; and WHEREAS, the PUD owns and operates utilities in Jefferson County, including water systems outside of the City's water service areas. The PUD is authorized to purchase and furnish water and to enter into agreements relating to water service areas and water supply sources; and WHEREAS, pursuant to a "Water Contract" dated May 19, 1983 ("the 1983 Contract"), the City provides and sells water to the PUD for the purpose of serving the PUD's "Glen Cove" service area. The 1983 Contract limits the quantity of water to the Glen Cove area to 50,000 gallons in any one day, subject to established rates. The attached Amended Water Contract amends the 1983 Water Contract; and WHEREAS, in order to defer several specific capital improvements, the PUD deems it to be in the best interest of its customers and pursuant to its discretion as a water utility, to seek additional water to serve the PUD's Glen Cove service area; and WHEREAS, pursuant to all terms and conditions within the Amended Water Contract, the City intends to provide additional water to the PUD from the City's water system in order to provide greater water quantity to serve the Glen Cove service area; and WHEREAS, the City approves the Amended Water Contract within its capacity as a water utility, for the utility-related reasons stated in the attached Contract; and WHEP~AS, the City Council's Utility Committee has reviewed the attached Amended Water Contract and unanimously recommends the Council approve the Amended Water Contract, i Res. 98- t9~5 NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port Townsend that the Mayor is authorized to execute the First Amendment to Water Contract in substantially the form as attached. ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor on this 2nd day of March, 1998.
