HomeMy WebLinkAbout98-029RESOLUTION No. 98-029 A RESOLUTION APPROVING CONDITIONAL USE PERMIT APPLICATION NO. LUP97-00002 WHEREAS, Puget Sound Energy has petitioned the City in accordance with Title 17 of the Port Townsend Municipal Code requesting a Conditional Use Permit to allow construction of a new substation and removal of the existing substation in the CH-MU zoning district; and WHEREAS, the proposal was duly noticed pursuant to Chapter 20.01 of the Port Townsend Municipal Code and three comment letters from nearby property owners were received; and WHEREAS, the Building and Community Development Director issued a Mitigated Determination of Non-Significance on January 28, 1998, and WHEREAS, Planning Commission conducted an open record public heating for the purpose of taking testimony, heating evidence, considering the facts germane to the proposal, and evaluating the proposal for consistency with adopted plans and regulations; and WHEREAS, City Council has held a closed record public heating for the purpose of considering the Planning Commission's recommendation and evidence in the record including any written comments and/or public testimony received; NOW THEREFORE, City Council hereby accepts and adopts the findings of fact, conclusions and project conditions as recommended by the Planning Commission dated February 19, 1998, subject to the following amendments to the project conditions: The applicant shall submit a final landscaping plan which is limited to drought tolerant and native plant species as specified in the preliminary landscaping plan (Exhibit 5) dated September 4, 1998, Last Revised January 23, 1998 and as further conditioned by this determination. The landscaping plan shall provide for screening and buffering from pedestrian and vehicular view on all four sides consistent with the need for visual access for security purposes. All landscaping shall be continually maintained in a healthy growing condition by the property owner. Dead or dying trees, shrubs or ground cover shall be replaced immediately, and the planting areas shall be routinely maintained. The use of herbicides shall be preclllded in the landscaped area and in the stormwater facilities. 10. Pursuant to Section 17.84.090, the conditional use permit shall automatically expire and become void if the applicant fails to obtain a building permit and energize the substation and install lan~l$caping and buffeting improvements within one (1) year from the effective date of the conditional use permit approval.
