HomeMy WebLinkAbout98-045A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT WITH ROBERT E. MURRAY AND ARDELLA F. MURRAY REGARDING THE PURCHASE OF LAND IN THE CITY AND AUTHORIZING THE TREASURER TO ISSUE WARRANTS FOR THE PURCHASE OF THE LAND IN ACCORDANCE WITH THE AGREEMENT Whereas, The City will be constructing a new water pipeline in 1998 in order to comply with an Agreed Order from the state Department of Health; and Whereas, A portion of the pipeline will be constructeed in the right of way for Howard Street to the South of SR 20/Sims Way in an area where wetlands in an existing drainage corridor inevitably will be impacted by the construction activities; and Whereas, Impacts to wetlands within the project area will be mitigated by replacement and by enhancement of other wetlands in the same drainage corridor in accordance with a wetland mitigation plan mandated by the Mitigated Determination of Nonsignificance issued by the City; and Whereas, A delineated wetland and drainage corridor adjacent to the Howard Street right of way and within platted real property presents an opportunity to accomplish many of the objectives of the wetland mitigation plan; and Whereas, Robert E. Murray and Ardella F. Murray, as trustees under agreement dated May 13, 1993, have agreed to sell to the City all of the real property owned by them adjacent to the right of way for Howard Street, lying Southerly of the right of way for Third Street and Northeasterly of the Olympic Gravity Water System right of way for a negotiated price of $18,700, which is an administrative settlement in lieu of condemnation, based on an appraisal by Stowe Appraisal, Inc., N 0 W T H E R E F 0 R E BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND that it authorizes the Mayor to sign an agreement with Robert E. Murray and Ardella F. Murray, as trustees under agreement dated May 13, 1993, regarding the purchase of all of Lots 8 through 14, inclusive, in Block 5, and all of Lot 11 in Block 6, National City No. 1, as per plat recorded in Volume 2 of Plats, page 150, records of Jefferson County, Washington, lying Westerly of the Olympic Gravity Water System right of way to the City of Port Townsend for the price of $18,700; and BE IT FURTHER RESOLVED that the Treasurer is authorized to issue the warrants necessary to complete the purchase of the land in accordance with said agreement. Adopted by the City Council of the City of Port Townsend and signed by the Mayor this 6th day of April, 1998.
