HomeMy WebLinkAbout98-053Resolution No. 98- ~) S 3 RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A LICENSE AGREEMENT WITH JEFFERSON COUNTY FARMERS MARKET, FOR THE USE OF CITY-OWNED PROPERTY FOR OPERATION OF THE PORT TOWNSEND FARMERS MARKET, ALLOWING THE MARKET TO OPERATE FROM 8:30 A.M. TO 3:00 P.M. ON SATURDAYS FOR A 10-YEAR PERIOD BEGINNING APRIL 20, 1998 The City Council of the City of Port Townsend, Washington, does resolve as follows: WHEREAS, the City Council adopted by Ordinance 2216, the Urban Waterfront Plan to allow for planning for future development of the Port Townsend Urban Waterfront; and ~rlIEREAS, the Urban Waterfront Plan encouraged the development of a seasonal public produce market in the downtown area; and WIIEREAS, since 1991, the Farmers Market has successfully operated a Saturday "open market" in the City-owned parking lot between 607 and 627 Water Street and the Waterfront Place right-of-way adjacent to Quincy Street; and ~, by Resolution 92-22, the City Council authorized the Farmers Market to use the above-referenced parking lot for a 10-year period on Saturday mornings between the hours of 8:30 A.M. and 12:00 noon only, with the time subsequently expanded to 3:00 P.M.; and WHEREAS, the limited use of portions of the Water Street lot and the Waterfront Place right-of-way has not significantly obstructed the primary use of the street to provide access to adjacent properties; and WHEREAS, over the past several years, the Farmers Market has been extremely sucx'~essful, and has attracted many patrons as well as vendors. As the market has expanded, vendors have found that the original site offers a limited ability for loading and unloading of produce and other products; is subject to windy conditions (without adequate shelter); and is not as open and accessible as desired for a friendly, locally oriented event; and WHEREAS, the City finds that the City Hall parking lot is a more suitable location for the market, in that the previous site is better suited for commercial district parking, benefiting commercial establishments located on Water Street; and 1 Res. 98- 0 5 ~ WI-W~REAS, since 1991, the City of Port Townsend has obtained significant benefits and cons'ffieration for allowing use of public property for the Market. These benefits include, but are not limited to: Implementation of goals and policies of the Port Townsend Urban Waterfront Plan; creating a Ucivic center" for local circulation in the Port Townsend Urban Waterfront area; drawing locals and visitors to the city's historic downtown area, thereby nurturing an appreciation and respect for the city's historical and cultural downtown center; encouraging and facilitating the production and sale of locally grown agricultural and craft products; tourism attraction and development; and sales tax generation; and WltEREAS, the expansion of the Farmers Market to the City Hall parking lot will provide substantial benefits to the community; and WHEREAS, the Jefferson County Farmers Market, a Washington non-profit corporation, has succeeded Main Street as the manager of the Market, necessitating negotiation of a new License Agreement for the use of public property for this purpose, NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port Townsend that the Mayor is hereby authorized to allow the Farmers Market to use the above- referenced portions of the Waterfront Place right-of-way for a Farmers Market during the limited hours cited above on a continuing basis for a 10-year period, with the provision that either party may renegotiate the agreement if circumstances change. ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor on this 20th day of April, 1998.
