RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
EXTENDING THE EXPIRATION DATE FOR RESOLUTION NO. 98-003,
IMPOSING A MORATORIUM UPON ACCEPTANCE AND CONSIDERATION
OF STREET VACATION APPLICATIONS
The City Council of the City of Port Townsend, Washington, resolves as follows:
WHEREAS, at the regularly scheduled August 4, 1997 City Council meeting, the Port
Townsend City Council adopted Resolution No. 97-92, suspending review and consideration
of street vacation applications pending adoption of the Comprehensive Non-Motorized Plan,
and imposing a moratorium upon acceptance and consideration of street vacation applications;
and
WHEREAS, Resolution No. 97-92 adopts a number of legislative Findings supporting
the moratorium action. Said Findings are reaffirmed and incorporated herein by this
reference; and
WHEREAS, in Resolution No. 97-92, the City Council provided that the moratorium
action would expire on Januar~ 1, 1998, or upon the City Council's adoption of the
Comprehensive Non-Motorized Plan, whichever date first occurs. However, the City Council
retained its discretion to extend the applicability of the Resolution after January 1, 1998, "in
the event the Comprehensive Non-Motorized Plan is not adopted on or before that date"; and
WHF. JIEAS, at a regularly scheduled' January 5, 1998 City Council meeting,
Resolution No. 98-003 was adopted, extending the effective date of Resolution 97-92 to
July 1, 1998 or upon adoption of the Non-Motorized Plan, whichever first occurred; and
WHEREAS, the Comprehensive Non-Motorized Plan was adopted on May 18, 1998,
by Ordinance No. 2643. However, the City Council intends to evaluate its existing policies
and regulations pertaining to right-of-way vacation application, which process may take several
months. Pending completion of that process, and implementation of the Non-Motorized Plan
through adoption of policies and/or regulations, the Council finds that processing new. street
vacation applications could significantly erode and limit planning and regulatory options to
implement the Non-Motorized Plan,
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port
Townsend as follows:
1. The City Council reaffirms its decision, set forth in Resolutions 97-92 and 98-003, to
not accept or process any applications for street vacations pending adoption and
implementation of the Port Townsend Comprehensive Non-Motorized Plan. The primary
reason for this action is to preserve all options for non-motorized circulation within Port
Townsend, until completion of all necessary planning studies, policy formulation and
regulations with regard to street rights-of-way which may need to be preserved and precluded
from any future street vacation action.
2. In accordance with the legislative findings set forth in Resolutions 97-92 and 98-003,
paragraph 4 of Resolution 97-92 is amended as follows:
