ORDINANCE NO. 3305
AN ORDINANCE OF THE CITY OF PORT TOWNSEND, WASHINGTON, RELATED
TO LIBRARY DONATIONS AND AMENDING PORT TOWNSEND MUNICIPAL
CODE SECTION 3.42.070
RECITALS:
The City of Port Townsend Library previously had a board of trustees that
operated with substantial autonomy under Chapter 27.12 RCW. When the City of
Port Townsend changed from a council -mayor form of government to a council-
manager form of government, the Port Townsend Library came the direction of
the City Manager. The Library Board of Trustees became the Library Advisory
Board.
2. Port Townsend Municipal Code section 3.42.070 continued to reference the
Library Board of Trustees and Chapter 27.12 RCW. This ordinance removes the
outdated references to the Library Board of Trustees and Chapter 27.12 RCW.
The Port Townsend Friends of the Library and Port Townsend Public Library
Foundation are dedicated to fundraising for and supporting the Port Townsend
Library. Because of the special relationship with these two organizations, the
process for accepting their donations should be streamlined. This ordinance
allows the City Manager, in consultation with the City Library Director, to accept
these organizations' donations to the Library in amounts that would normally
require City Council approval.
NOW, THEREFORE, the City Council of the City of Port Townsend ordains as
follows:
Section l Amendment. Section 3.42.070 of the Port Townsend Municipal Code is
amended in substantially the same form as set forth in Exhibit A.
octio n 2. Severability. If any sentence, clause or phrase of this ordinance should be held
to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause or phrase or work of this ordinance.
ctiotwi3,. Notwithstanding any provisions to the contrary in Chapter 1.01.015 of the
Port Townsend Municipal Code, staff and the Code Reviser are authorized to update and
incorporate changes adopted in the Port Townsend Municipal Code. Staff and the Code Reviser
are further authorized to make non -substantive edits related to numbering, grammar, spelling,
and formatting consistent with this Ordinance.

Section 4. Effective Date. This ordinance sball take effect and be in force five days
following its publication in the manner provided by law.
ADOPTED by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this 6th day of March 2023.
