HomeMy WebLinkAbout98-121Resolution No. 98- /~- / RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND APPROVING SYSTEM DEVELOPMENT CHARGE DEFERRALS FOR QUALIFIED APPLICANTS, IN ACCORDANCE WITH PTMC 13.03.110 The City Council of the City of Port Townsend, WashingtOn, does resolve as follows: WHEREAS, at the regularly scheduled November 2, 1998 ICity Council meeting, the City Council adopted Ordinance No. 2667, adding a new section 13.03.110 to the Port Townsend Municipal Code, establishing a program and a special account for paying deferred water and sewer system development charges (SDCs) from the general fund, into the SDC fund, for qualified low income housing applicants, thereby lowering the cost to provide housing to low income applicants; and WHEREAS, at the November 2, 1998 City Council meeting, the Council also adopted Ordinance No. 2666, amending the 1998 budget to appropriate the sum of $15,000 to fund the 1998 low income housing SDC deferral program; and WHEREAS, Ordinance 2667 was made applicable to all qualified applicants who paid or would be required to pay SDCs during 1998, enabling reimburse~aent of previously paid SDCs, so long as the applicants made the reimbursement request to the City Council within 30 days of the adoption date of Ordinance No. 2667; and WHEREAS, Habitat for Humanity has requested SDC deferral for Ms. Christie Apker, and affirms that Ms. Apker qualifies for deferral of SDCs for the home constructed through a Habitat for Humanity project, at 1262 16th Street, Port Townsend, and has provided the City with satisfactory documentation demonstrating that Ms. Apker meets the income qualifications as defined in Ordinance No. 2667. The Habitat for Humanity housing program meets the requirements for non-profit organizations as set forth in Ordinance 2667; and WHEREAS, Kitsap County Consolidated Housing Authority, on behalf of the Jefferson County Housing Authority and the Jefferson County Community Action Council, has requested SDC deferrals for three individuals who have participated in the "Self Help Home Builders" program, and who have paid SDCs since January 1, 1998. These individuals are: (1) Silvia Arthur; 1265 Eddy Street, Port Townsend; (2) Nina and Russell Slagle, 1287 Eddy Street; and (3) Gloria Espinosa-Hall, 1211 Eddy Street. Kitsap County Consolidated Housing Authority has provided the City with adequate documentation demonstrating that these three individuals meet the income qualifications as defined in Ordinance No. 2667. The Kitsap County Consolidated Housing Authority, the Jefferson County Housing Authority and the Jefferson County Community Action Council housing program meet the requirements as set forth in Ordinance No. 2667; and 1 Res. 98- /E I WHEREAS, the City Council hereby finds that the goals of encouraging affordable housing in Port Townsend are advanced by deferring SDCs for the referenced qualified applicants, dividing the sum of $15,000 appropriated through the 1998 budget into the SDC deferral account, between these four qualified applicants, subject to all requirements its set forth in Ordinance 2667 (PTMC 13.03.110), enabling each of the applicants to defer (and, as applicable, receive reimbursement) in the sum of $3,750 for SDCs, NOW, THEREFORE, BE IT RESOLVED, by the Cit~ Council for the City of Port Townsend as follows: 1. SDCs are hereby deferred for the four applicants as specified herein, in the amount of $3,750 each; provided, however, such deferral is contingent upon the applicants executing real estate security agreements prepared by the City Attorney. Any of Such applicants who have paid SDCs after January 1, 1998 shall be entitled to a reimbursement, ~ayable from the SDC deferral account, in the amount of $3,750, upon executing necessary real bstate security agreements. 2. SDCs shall be deferred and reimbursed as applicable for the following applicants, of the homes constructed at the following Port Townsend addressesl (1) Ms Christie Apker, 1262 16th Street; (2) Silvia Arthur, 1265 Eddy Street; (3) Nina and RusSell Slagle, 1287 Eddy Street; and (4) Gloria Espinosa-Hall, 1211 Eddy Street. 3. The City Finance Director shall allocate the deferred funds between the water and wastewater SDC funds or accounts as deemed appropriate. 4. The City Attorney is directed to prepare all nec~ssm3t real estate transaction documents to enable the SDC deferrals and reimbursements as de ~cribed herein. ~end and signed by the Mayor ADOPTED by the City Council of the City of Port Town on this 7th day of December, 1998.
