ORDINANCE NO. 3290
AN ORDINANCE OF THE CITY OF PORT TOWNSEND, WASHINGTON, RELATED
TO THE WATER SYSTEM AND AMENDING PORT TOWNSEND MUNICIPAL CODE
CHAPTER 13.17 CROSS -CONNECTIONS
RECITALS:
The City Council of Port Townsend finds as follows:
1. A water purveyor, such as the City of Port Townsend, must provide water to the customer at
the meter that meets Washington state water quality standards.
2. A water purveyor must prevent the contamination of the public water system from the
source of supply (i.e., to the customer's connection to the service pipe or meter).
3. The Washington State Department of Health (DOH) requires a water purveyor to establish a
cross connection -control program satisfactory to DOH.
4. Cross -connections within the customer's plumbing system pose a potential source for the
contamination of the public water supply system.
NOW, THEREFORE, the City Council of the City of Port Townsends hereby ordains as
follows:
Section I.. Chapter 13.17 Cross Connections is amended as indicated in Exhibit A.
Section 2. Severability. If any sentence, clause or phrase of this ordinance should be held to be
invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause or phrase or work of this ordinance.
Section 3. Effective Date. This ordinance shall take effect and be in force five days after the
date of its publication in the manner provided by law. Publication of this ordinance shall be by
summary thereof consisting of the title.

13.17.010 Purpose.
The purpose of this chapter is to protect the city water supply from contamination or pollution
from potential cross -connections and assure that approved backflow devices are installed and

13.17.020 Cross -connection prohibited.
The installation or maintenance of any cross -connection which would endanger the water supply

13.17.030 Cross -connection control policies and procedures.
The control or elimination of cross -connections shall be in accordance with WAC 246-290-490
et seq as hereafter amended. The policies, procedures and criteria for determining appropriate
levels of protection shall be in accordance with the Accepted Procedure and Practice in Cross
Connection Control Manual — Pacific Northwest Section — American Water Works Association,

13.17.040 Cross -connection control testing.

cross -connection control as required by state or federal law, t4e eagiaeefiag desigo s�aada-as

13.17.050 Customer responsibilities — Inspections.

A. Customer Responsibility. Water service to any premises shall be contingent upon the
customer providing cross -connection control in a manner approved by the city. Backflow devices
required to be installed shall be a model approved by the Washington State Department of
Health.
B. Inspections. Inspection and right of entry for cross -connection control purposes shall be
governed by Chapter 13.11 PTMC. Water service may be terminated or refused to any premises
for failure to allow necessary inspections or to protect the water system from danger.

A. Director's Authority. Whenever the public works director or his or her designee ("director")
determines that a condition exists in violation of this chapter or anv standard reauired to be
adhered to by this chapter, or in violation of any permit issued hereunder, he or she is authorized
to enforce the provisions of this chapter.
B. Chapter 1.20 PTMC Applicable. All violations of any provision of this chapter or
incorporated standards, or of any permit or license issued hereunder, are declared nuisances and
made subject to the administration and enforcement provisions of Chapter 1.20 PTMC, including
any amendments, and including but not limited to abatement, criminal penalty, and civil penalty
as set forth in Chapter 1.20 PTMC, which are incorporated by reference as if set forth herein.
