A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
DECLARING THE PURCHASE OF A" LAYTON" BOX FROM CLYDE/WEST A
"SPECIAL MARKET CONDITION" PURCHASE THEREBY AUTHORIZING THE
PURCHASE OF THIS EQUIPMENT WITHOUT CALLING FOR BIDS.
WHEREAS,
In an effort to respond to citizen complaints in a more timely and cost effective
manner the Streets Department would like to purchase street repair machinery;
and
WHEREAS, A "Layton "Box is a common piece of equipment used in road repair; and
WHEREAS, A used "Layton" Box Model F525 which has appeared on the State Bid is
available from the supplier at a substantial savings; and
WHEREAS, RCW 35.23.352(9) authorizes purchasing equipment with "Special Market
Conditions" without calling for bids; and
WHEREAS, The statute requires a resolution by Council declaring an exemption from bidding
under the "Special Market Conditions" provision,
N O W T H E R E F O R E
Be It Resolved that the City Council of the City of Port Townsend declares the purchase of a
used "Layton" Box from Clyde/West a "Special Market Condition" and authorizes the purchase
of the "Layton Box" without calling for bids, with the purchase to be conditioned upon receipt of
a warranty on the equipment which will be effective through September 30, 1999.
ADOPTED by the City Council of the City of Port Townsend, and signed by the Mayor this
15th day of March, 1999.
