RESOLUTION 21-073
A RESOLUTION DECLARING AN EMERGENCY AND RATIFYING THE CITY
MANAGER'S APPROVAL OF ALL APPLICABLE DOCUMENTS TO ALLOW FOR
THE REPAIR OF THE MOUNTAIN VIEW AND CITY HALL HEATING SYSTEMS
WHEREAS, Section 3.46.090 of the City of Port Townsend Municipal Code, and
Section 39.04.280(1)(c) of the Revised Code of Washington allows exemptions to competitive
bidding requirements under emergency conditions; and
WHEREAS, on October 29, 2021, the City's Mountain View Campus Air Handler Unit
#1 was non-functional leaving parts of the Mountain View campus without heat; and
WHEREAS, during the weekend of October 30-31, 2021, the City Hall boilers stopped
working leaving the building without heat; and
WHEREAS, the City Manager has declared repairs to the heating systems an emergent
situation based on the need to immediately repair those systems so that City staff, tenants, and
customers can work during the lower outdoor temperatures; and
WHEREAS, the City's municipal code requires City Council to concur with the City
Manager's declaration of emergency by passage of a resolution; and
WHEREAS, the City Council finds that it is in the best interest of the City to declare an
emergency and authorize the execution of all necessary documents to repair the heating systems.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend as follows:
Section 1. The City Council hereby declares an emergency justifying the waiver of
certain contracting processes.
Section 2. The City Manager and Public Works Director's actions as set out in their
Memorandum dated October 29, 2021 and updated November 1, 2021, are ratified and
confirmed.
Section 3. The City Manager may take any additional administrative actions consistent
with this resolution.
