HomeMy WebLinkAbout99-052RESOLUTION 99- DS,~ A RESOLUTION APPROVING THE FIFTH AMENDMENT TO THE PROPERTY USE AND DEVELOPMENT AGREEMENT FOR THE ROSEWIND PLANNED UNIT DEVELOPMENT WHEREAS, the City and the Rosewind Cohousing Association (RoseWind), entered into a certain Property Use and Development Agreement for the Rosewind Planned Unit Development on May 12, 1994; and WHEREAS, Peter and Helen Lauritzen have requested an amendment to reduce the building setbacks from the west and north property lines of Rosewind Lot 7 from 5 feet to 2 feet and from 10 feet to 0 feet, respectively; and WHEREAS, the abutting property owners of Rosewind Lot 8, Geralynn and Richard Rackowski, do not object to the proposed setback reductions; and WHEREAS, the proposed setback reductions will not affect pedestrian and vehicular access to Lot 7 or to nearby properties and will not impact utility service to the area; and WHEREAS, the purpose of the proposal is to allow the first floor of the single family dwelling to be designed as handicapped accessible; and WHEREAS, the Planning Commission concluded that the proposed setback reductions would not substantially change the development and that consequently a public hearing is not required. The City Council has accepted the Planning Commission's recommendation, NOW THEREFORE, City Council hereby accepts and adopts the findings of fact, conclusions and project conditions as recommended by the Planning Commission dated July 29, 1999, and authorizes the Mayor to sign the FiRh amendment to the Rosewind PUDA in substantially the form attached hereto.
