HomeMy WebLinkAbout99-053RESOLUTION 99- t9 53 A RESOLUTION APPROVING THE SIXTH AMENDMENT TO THE PROPERTY USE AND DEVELOPMENT AGREEMENT FOR THE ROSEWIND PLANNED UNIT DEVELOPMENT WHEREAS, the City and the Rosewind Cohousing Association (Rosewind), entered into a certain Property Use and Development Agreement for the Rosewind Planned Unit Development on May 12, 1994; and WHEREAS, Leonard Zweig, on behalf of the Rosewind Cohousing Homeowners' Association, has requested an amendment to define two individual lots within the boundaries of the multi-family lot area of Rosewind. The amendment would also reduce the south setback of Lots 20 - 26 from 20 feet to 10 feet; and WI-IEREAS, the proposed amendment will not increase the approved residential density in the multi- family area; and WHEREAS, the proposed setback reduction will not affect pedestrian and vehicular access to Lots 20 - 26 or to nearby properties and will not impact utility service to the area; and WHEREAS; the proposed amendment will encourage the provision of affordable housing in Rosewind and will provide flexibility in developing the multi-family portion of the Rosewind PUDA; and WHEREAS, the Planning Commission concluded that defining the proposed lots and the proposed setback reduction would not substantially change the development and that consequently a public hearing is not required. The City Council has accepted the Planning Commission's recommendation, NOW TtiEREFORE, City Council hereby accepts and adopts the findings of fact, conclusions and project conditions as recommended by the Planning Commission dated August 12, 1999, and authorizes the Mayor to sign the Sixth amendment to the Rosewind PUDA in substantially the form attached hereto.
