AN ORDINANCE OF THE CITY OF PORT TOWNSEND, WASHINGTON,ADOPTING
THE STORMWATER MANAGEMENT MITIGATION PAYMENT PROGRAM FOR
STORMWATER FLOW DETENTION IN-LIEU-OF ON-SITE CONSTRUCTION FOR
THE RAINIER REGIONAL STORMWATER FACILITY BENEFIT AREA
WHEREAS, the City of Port Townsend establishes a Payment In-Lieu-of Construction
Program (Program); and
WHEREAS, the Program allows property owners for a qualified project site within the
Rainier regional stormwater benefit area to pay a mitigation fee in lieu of on-site detention, and
where applicable, to utilize the Rainier Regional Stormwater Infiltration Facility; and
WHEREAS, the City owns the Rainier Regional Stormwater Facility and associated
infrastructure; and
WHEREAS, it is necessary to establish a mitigation payment charge for utilization of the
Rainier Regional Stormwater Facility; and
WHEREAS, as determined an applicant qualified under this Program shall be assessed a
one-time system development charge of$1.20 per square foot of surface requiring mitigation for
stormwater detention on in accordance with the allocation plan for the Rainier Regional
Stormwater Facility; and
WHEREAS, the system development charge of$1.20 per square foot shall increase each
year at the 3%(three percent)rate of interest being paid for the CERB loan that finances the Rainier
the Regional Stormwater Facility; and
WHEREAS,the allocation of impervious surface mitigation area shall be as defined in the
special assessment spreadsheet and Rainier Regional Stormwater Management Plan maintained
by the Public Works Department; and
WHEREAS, the Rainier Regional Stormwater Facility Plan establishes the methodology
for calculation of the mitigation fees based on an allocated land area; and
WHEREAS, unused mitigation allocation to an assigned property in the benefit may be
reallocated.
NOW THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
Section 1. That applicants qualified under the Payment In-Lieu-of-Construction Program to
utilize the Rainier Regional Stormwater Facility shall be assessed a system development
charge of $1.20 per square foot of surface area requiring stormwater mitigation, which
charge shall increase by 3% (three percent) each year beginning in 2022.

Section 2. Allocation of the mitigation area for each property in the benefit area shall be as
established and maintained by the Public Works Department for the Regional Stormwater
Facility.
Section 3. In order to qualify for the Payment In-Lieu-of-Construction Program for the
Rainier Regional Stormwater Facility, the benefitted premises must be located in the area
shown on the map attached as Exhibit A and hereby adopted by this reference.
ADOPTED by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this 7th day of June 2021.
