RESOLUTION NO. 21-011
A RESOLUTION OF THE CITY OF PORT TOWNSEND RELATED TO
STORMWATER MANAGEMENT; AUTHORIZING THE CITY MANAGER TO SIGN
A RELEASE RELATED TO A PRIVATE STORMWATER FACILITY
WHEREAS, Margaret Takaki and Gene Kacson applied for an Environmentally
Sensitive Areas Permit that allowed them to construct a private stormwater system that collected
stormwater on their properties (Jefferson County Tax Parcels 989-703-302 and 989-703-304),
which system discharges over the bluff above Highway 20 (Permits LUP97-00084 and LUP97-
00083; and,
WHEREAS, Council previously approved a partial release for Ms. Takaki in 2016 when
she constructed a separate stormwater system, which system complies with the City's
Engineering Design Standards (Resolution No. 16-030; Assessor's File Number 600823); and,
WHEREAS, Mr. Kacson wishes to construct a separate stormwater system, which
system complies with the City's Engineering Design Standards and to remove the above ground
components of the existing system and select components of the underground system; and
WHEREAS, Mr. Kacson seeks a release from the obligations under the original permit;
and
WHEREAS, staff has reviewed the proposed design, and the release, and has determined
that granting the release will not be a detriment to the City's interests.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend as follows:
The City Manager is authorized to sign a release in favor of Mr. Gene Kacson or his
successors-in-interest related to the private stormwater system authorized by City Permits
LUP97-00084 and LUP97-00083.
ADOPTED by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this 1 st day of February 2021.
