RESOLUTION NO. 20-022
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE AN UNDERGROUND UTILITY EASEMENT WITH WAVE BUSINESS
SOLUTIONS, LLC ACROSS PORTIONS OF THE CITY'S ROTARY PARK PROPERTY
WHEREAS, WAVE BUSINESS SOLUTIONS, LLC is a communications company with a
contract to provide fiber optics to the Washington State ferry terminal located on Water Street in
Port Townsend; and,
WHEREAS, in order to provide fiber optics to the ferry terminal, WAVE requires an
easement across City of Port Townsend owned property adjacent to the ferry terminal; and,
WHEREAS, the property is subject to a lease held by US Bank; and,
WHEREAS, when the City renewed the lease with US Bank, the City reserved the right to
construct restrooms on the property in the future; and
WHEREAS, the easement area will not encroach on the site reserved for the restrooms;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend, Washington, that the City Manager is authorized to negotiate and execute an easement
for WAVE BUSINESS SOLUTIONS, LLC to install fiber optic conduit in City property adjacent
to the Washington State ferry terminal.
ADOPTED by the City Council of Port Townsend, Washington, at a regular meeting
thereof, held this 4th day of May 2020.
