RESOLUTION NO. 20-011
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE A POSSESSION AND USE AGREEMENT AND FINAL EASEMENT FOR
THE REGIONAL STORMWATER FACILITY WITHIN THE AVAILABLE PROJECT
BUDGET AND FUNDING
WHEREAS, on May 16, 2016, City Council approved Resolution 16-024 that authorized
the City Manager to award and sign all contracts for the design and construction of the Howard
Street (now renamed Rainier Street) regional stormwater project; and,
WHEREAS, on February 18, 2020, City Council approved an application for a Public
Infrastructure Fund (PIF) grant application for the project in Resolution 20-007; and,
WHEREAS, on March 2, 2020, in Resolution 20-009, the City Council approved the PIF
grant and authorized an increase in the project budget; and,
WHEREAS, the next step is to secure the property easement for the stormwater line
starting with a possession and use agreement and then a final easement document once the in-place
alignment is settled;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend, Washington, that the City Manager is authorized to negotiate and execute a possession
and use agreement and final easement document for the regional stormwater project within the
available project budget and funding.
ADOPTED by the City Council of Port Townsend, Washington, at a regular meeting
thereof, held this 16th day of March 2020.
