RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND DENYING APPLICATION FOR CONDITIONAL USE
PERMIT, APPLICATION LUP00-039
The City Council .of the City of Port Townsend, Washington resolves as follows:
WHEREAS, Port Townsend Assisted Living, LLC has petitioned the City for
Conditional Use Permit approval to allow phased construction of a 74-unit
congregate care facility within the R-II medium-density, single-family zoning
district; and
WHEREAS, by Resolution 00-064, adopted November 20, 2000, the Council
granted a SEPA appeal to the MDNS issued August 16, 2000, and modified the
MDNS to include the following additional mitigation:
"1. The assisted living facility shall be broken up into a collection of
structures such that no more than four (4) assisted living units (studios or
one-bedroom apartments) are located within any one structure."
And further, the Council Resolution 00-064, adopted November 20, 2000,
required:
"The applicant, Port Townsend Assisted Living, LLC, is hereby required to
revise the Conditional Use Permit application, including site plan and
project description, to comply with the required mitigation. Upon receipt
of the necessary revisions demonstrating compliance with this mitigation, a
decision on the Conditional Use application shall be rendered by the City
Council."
WHEREAS, by letter dated January 23, 2001 from Phil Olbrechts, attorney for
the applicants, the applicant states the applicant has decided to limit its project
revisions to the elimination of the proposed microwaves in the residents'
sleeping quarters.
WHEREAS, this proposal, as revised by the applicant's proposal contained in
the letter dated January 23, 2001 from Phil Olbrechts, fails to meet the terms of
the SEPA decision, as declared by Resolution 00-064, adopted November 20,
2000.

NOW, THEREFORE, BE IT RESOLVED by the City Council:
The application under LUP00-039 for a conditional use permit for a 74-unit
congregate care facility is hereby denied, since the application, with revisions,
makes no attempt to meet or comply with the MDNS issued August 16, 2000, as
modified by Resolution 00-064, adopted November 20, 2000
ADOPTED by the City Council of the City of Port Townsend on the 19th day of
March, 2001 and signed by the Mayor on this 19th day of March, 2001.
