A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
WASHINGTON AUTHORIZING THE CITY MANAGER TO SIGN AN AGREEMENT
WITH D.M. DISPOSAL TO PROVIDE SOLID WASTE DISPOSAL SERVICES AND
THE ASSO'CIATED BILLING FOR THESE SERVICES
WHEREAS, the current contract with Superior Refuse Removal, Inc. was approved by
the City Council and signed in December 1997 for a period of five years. It expires in December
2002. Many problems arose under the previous management of Superior Refuse and their
interpretation of the contract. Most of these problems were reduced or eliminated entirely when
WCI took control of Superior Refuse in 1999; and
WHEREAS, the original intent of opening contract negotiations with D.M. Disposal was
to have the contractor take over the billing function currently done by the City. A contract
extension became a primary incentive to make this work for the contractor. Negotiations
expanded to include discussions to clear up other parts of the existing contract; and
WHEREAS, previous direction from the City Council Public Works Committee
included the following contract goals: a) maintain mandatory service requirement; b) transfer
billing responsibilities to contractor~ c) keep senior/disabled discount policy; d) keep rate
structure essentially as it is now with some shift of actual cost to residential customers; and e) set
new contract administrative fee at 10%; and
WHEREAS, City Council has reviewed the contract proposal and directed staff to bring
forward a resolution authorizing the City Manager to execute the contract and then provide
various housekeeping ordinances which will bring the contract and the City Code into
conformance;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend that the City Manager is authorized to enter into an agreement with D.M. Disposal to
provide both solid waste disposal services and billing for those services consistent with the solid
waste contract summary presented at the February 11, 2002 City Council meeting.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting
