A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PORT TOWNSEND, WASHINGTON DECLARING THE
CITY COUNCIL'S INTENT THAT MODIFICATIONS OF
PLANNED UNIT DEVELOPMENTS APPROVED PRIOR TO
ADOPTION OF PTMC 17.32.130 SHALL BE PROCESSED
ACCORDING TO PTMC 17.32.130
WHEREAS, in 1997 by Ordinance No. 2571, the City Council adopted provisions
relating to planned unit developments, which provisions were codified at Chapter 17.32 PTMC.
Section 17.32.130 provides that minor modifications of PUDs would be processed according to
Type I decision (BCD Director determination), and major modifications would be processed as
Type III decision (hearing and final decision with a hearing officer); and
WHEREAS, prior to the adoption of Ordinance 2571, PUDs were governed by Chapter
17.40 PTMC, which provided for City Council approval for modifications of PUDs; with the
adoption of Ordinance 2571, Chapter 17.40 PTMC was repealed; and
WHEREAS, the Council declares its intention that modifications of PUDs approved
prior to the adoption of Ordinance 2571 should be processed according to the provisions of said
Ordinance codified in PTMC 17.32.130.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend as follows:
The Council declares its intention that procedural requirements for processing
modifications of Planned Unit Developments (PUDs) contained in PTMC 17.32. t 30 shall
apply to PUDs approved prior to the adoption of PTMC 17.32.130. This declaration of
intent does not in any way affect development standards and conditions that apply to
PUDs approved prior to the adoption of PTMC 17.32.130, which development standards
and conditions shall remain in full force and effect, subject to the terms of the PUD, the
approval decision, and any development agreement, and which may be subject to
modification according to procedures contained in PTMC 17.32.130

ADOPTED by the City Council of the City of Port Townsend at a regular meeting
thereof, held this fourth day of March, 2002.
