HomeMy WebLinkAbout051319 Special CITY OF PORT TOWNSEND MINUTES OF THE CITY COUNCIL SPECIAL BUSINESS MEETING OF MAY 13, 2019 CALL TO ORDER/PLEDGE OF ALLEGIANCE The Port Townsend City Council met in special session on the 13th day of May 2019 in Council Chambers at 540 Water Street. Mayor Deborah Stinson called the meeting to order at 6:30 p.m. ROLL CALL Councilmembers present at roll call were Pamela Adams, David Faber, Robert Gray, Michelle Sandoval, Ariel Speser, and Deborah Stinson with Amy Howard excused. Staff members present were City Manager David Timmons, City Attorney Heidi Greenwood, Development Services Director Lance Bailey, Finance and Administrative Services Director Nora Mitchell, Code Enforcement Officer Katie Quesada, and City Clerk Joanna Sanders. PUBLIC HEARING Ordinance 3225 Amending Port Townsend Municipal Code Chapter 17.22 and Adding Port Townsend Municipal Code Chapter 17.31 Relating to Interim Land Use Regulations in the Area Bound on the East by Rainier St, on the South by Sims Way, on the West by Discovery Rd and on the North by 10th Street, and Providing that the Interim Regulations, Unless Extended, will Sunset on the Earlier of Six (6) Months from the date of Adoption of this Ordinance or the Adoption of Regulations the Supersede this Ordinance Mayor Stinson read rules of procedure for the public hearing. There were no Council financial or property issues to disclosure in connection with this matter. Development Services Director Lance Bailey gave the staff presentation on the expansion of the interim regulations currently in place for the Makers/Artisan area. He noted a new set of definitions were provided to cover the majority of the underdeveloped land within the subarea that has newly installed infrastructure and which is expected to experience the highest degree of development potential. He explained Phase 1 is the adoption of the subarea plan narrative. Phase 2 involves the rezoning of parcels and adopting revisions to the zoning map consistent with the Comprehensive Plan Land Use Map completed in Phase 1. In addition, Phase 2 includes the option of development regulations necessary to fully implement the Subarea Plan. Mr. Bailey explained that a new definitions section is included and a new chapter addresses the commercial focus overlay. The existing interim regulations would expire as written with the new regulations taking their place. There was no public testimony. City Council Special Business Meeting May 13, 2019 Pagel of 4 Mr. Bailey addressed questions about impacts to existing businesses in the Port Townsend Business Park such as Creative Systems. The public testimony was closed. UNFINISHED BUSINESS Ordinance 3226 Adopting 2019 Supplemental Budget Appropriations Finance and Administrative Services Director Nora Mitchell reviewed the supplemental budget request for the reappropriation of capital items unexpended in the 2018 budget into 2019. First reading was approved at a prior meeting. There was no public comment. Motion: Michelle Sandoval moved to approve Ordinance 3226 Adopting 2019 Supplemental Budget Appropriations. Pamela Adams seconded. Vote: motion carried unanimously, 6-0 by voice vote. Ordinance 3227 Establishing a Revolving Line of Credit and Providing for the Issuance and Sale of a Limited Tax General Obligation Bond Anticipation Note in the Aggregate Principal Amount of not to Exceed $1,500,000 to Evidence the Line of Credit to be Used to Repay the City's Existing Line of Credit and to Finance Capital Improvements to City Streets and Facilities, and Fixing the Form, Covenants and Terms of the Note Ms. Mitchell presented the ordinance for second reading. She noted the correction in the title to include "City Streets and Facilities." She responded to a question about Water Street Enhancement funding and the need for long-term financing. Referring to financial policies related to temporary funding of the project and resolution of that funding within six months, Ms. Mitchell said the closeout of the project can continue up until a year after project completion because that is when project costs are known. A correction may be needed to the policies to clarify the process. City Manager David Timmons explained debt refinancing the earliest of which would occur in September 2020. Ordinance 3224 Amending Port Townsend Municipal Code Chapter 16.08 Flood Damage Prevention, Adopting the "Flood Insurance Study for Jefferson County, Washington and Incorporated Areas" and Flood Insurance Rate Maps (FIRMS) Dated June 7, 2019, and Any Revisions Thereto Planning Manager Judy Surber explained the additional change to exclude 16.08.120F is now reflected in the proposed Exhibit A. There was no public comment. Motion:Ariel Speser moved to approve Ordinance 3224 Amending Port Townsend Municipal Code Chapter 16.08 Flood Damage Prevention, Adopting the "Flood Insurance Study for Jefferson County, Washington and Incorporated Areas"and Flood Insurance Rate Maps (FIRMS) Dated June 7, 2019, and Any Revisions Thereto. Pamela Adams seconded. Vote: motion carried unanimously, 6-0 by voice vote. NEW BUSINESS Tasking the Parks, Recreation & Tree Advisory Board with Reviewing & recommending the Rules & Signage for the Dog Park and Leash Law Educational Materials for Residents &the Visitor Center Finance and Administrative Services Director Nora Mitchell noted this item came forward from the last InBox review meeting. Public Comment: Ed Robeau spoke about the importance of education on leash laws. He distributed a brochure he prepared to educate the public about leash laws in the City. Motion:Ariel Speser moved to approve tasking the Parks, Recreation and Tree Advisory Board with reviewing and recommending the rules and signage for the dog park and leash law educational materials for residents and the Visitor Center. Robert Gray seconded. Vote: motion carried unanimously, 6-0 by voice vote. Code Enforcement Priorities City Attorney Heidi Greenwood reviewed a presentation of the City's code enforcement history Mr. Bailey talked about how various departments of the City get involved in code compliance. Ms. Greenwood and Code Enforcement Officer Katie Quesada City Council Special Business Meeting May 13, 2019 Page 3 of 4 reviewed samples of code enforcement actions and the resulting clean up of nuisance properties. Mr. Bailey noted that the State has delayed adoption of the building code, but staff plans to bring forward an adoption of the property maintenance code and the update of the building code concurrently. Questions related to expanding the feeding of animals to include cougars, coyotes and other predators. Ms. Quesada noted that certain wild animals are covered as illegal to feed as part of state regulations through the Department of Fish and Wildlife. Public Comment: David Gomez asked about the process for addressing abandoned property. Ed Robeau urged considering language in the municipal code cautioning residents against leaving food out after feeding animals because of unintentionally feeding rats and racoons. Ms. Greenwood noted that the landlord-tenant law addresses abandoned property. It is a challenge to craft laws on feeding and unintentional feeding of animals. She also recognized the difficulty with addressing food/garden safety because of cats using garden areas. Some discussion ensued about code enforcement complaints, including fences in the right of way. Consistency and predictability in code enforcement is important and under the authority of the City Manager with guidance from Council. In reviewing Resolution 10-002 related to fences in the right of way, Council may need to review its priorities and consider how to ensure code enforcement equity. Mr. Timmons reported on his conversation with Fish and Wildlife and their recommendation on not feeding the deer to disperse the population and Staff intends to return with wildlife code provisions. EXECUTIVE SESSION — PURSUANT TO RCW 42.30.110(1)(1) CURRENT OR POTENTIAL LITIGATION At 8:18 p.m., Council went into Executive Session for 20 minutes with no action to follow. At 8:38 p.m., Council came back into open session.
