ORDINANCE NO. 3222
AN ORDINANCE OF THE CITY OF PORT TOWNSEND RELATED TO UTILITY
RATES; AMENDING THE STORMWATER RATES; AMENDING CHAPTER 13.05 OF
THE PORT TOWNSEND MUNICIPAL CODE, AND ESTABLISHING AN EFFECTIVE
DATE
RECITALS
1. In 2016, Council adopted Ordinance 3145, that implemented a capital surcharge on
Stormwater customers of$3.00 per month.
2. In April 2019, Council adopted Ordinance 3219 adopting the updated Stormwater
Management Plan that recommended capital investments to manage the City's
stormwater infrastructure. In order to fund the needed capital investments, the City
considered the stormwater utility's capital surcharge.
3. In 2019, the Finance and Budget Committee evaluated the stormwater management plan
and the proposed capital surcharge and recommended an increase to $6 for the monthly
surcharge.
NOW THEREFORE, the City Council of the City of Port Townsend do ordain as
follows:
Section 1. Amendment. Effective July 1, 2019 Section 13.05.050(D) of the Port
Townsend Municipal Code ("PTMC") is amended to read as follows, and the stormwater
capital surcharge in PTMC 13.05.050 is amended as follows. The existing stormwater
capital surcharge rate is repealed as the new rate set by this Ordinance takes effect:
D. Capital Surcharge. There is imposed a . $6.00 monthly surcharge per stormwater
utility account
Section 2. Severability If any provision of this Ordinance or its application to any
person or circumstance is held invalid, the remainder of the ordinance, or the application
of the provision to other persons or circumstances is not affected.
Section 3. Effective Date. This Ordinance shall take effect and be in force five days after
the date of its publication in the manner provided by law. The new rates shall go into
effect on July 1, 2019.
