A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON AUTHORIZING LATECOMER UTILITY CONTRACTS PURSUANT
TO RCW CHAPTER 35.91 AND PTMC CHAPTER 13.28
WHEREAS, Keith Marzan ("Marzan") haVe constructed or caused to be constructed an
8-inch sewer line in R Street from Walnut to Chestnut; an 8~inch PVC water line and street
improvements in R Street from Chestnut to Oak; and
WHEREAS, Marzan wishes to enter into an Agreement with the City, pursuant to RCW
Chapter 35.91, as amended, and PTMC Chapter 13.28, to provide for partial reimbursement of
the costs of such improvements by subsequent users or connectors to the lines and street
improvements; and
WHEREAS, notice has been provided in writing to the owners of property within the
benefit reimbursement area and no appeal has been filed within the period specified in the notice,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend as follows:
That the Mayor is hereby authorized to execute on behalf of the City an agreement
providing for the partial reimbursement of the costs of construction of the utility lines and street
improvements by the person(s) named herein through payments from subseqUent users or
connectors to said utility lines and street improvements.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting
thereof, held this 17th day of June, 2002.
