HomeMy WebLinkAbout02-044Resolution No. 02-044 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND GRANTING FINAL PLAT APPROVAL TO THE HENSEL SUBDIVISION, APPLICATION LUP 02-085 SUBJECT TO EXECUTION OF FINAL DOCUMENTS The City Council of the City of Port Townsend, Washington resolves as follows: WHEREAS, Jack L. Hensel has petitioned the City for final approval of a 13-lot preliminary plat known as the Hensel Subdivision (LUP02-085) located between East Caroline Street and Diamond Street, approximately 500-feet south of 53ra Street and 125-feet east of Magnolia Street in the Fowler's Park area of Port Townsend; and WHEREAS, the original preliminary plat application was submitted on or about March 11, 1998 (LUP98-11) and consisted of a replat of 34-existing lots encompassing approximately 4-acres of the Fowler's Park Addition to the City of Port Townsend; and WHEREAS, the Hensel (formally Crist) Preliminary Plat was approved by City Council on August 2, 1999; and WHEREAS, the Public Works Director has found the plat to be in compliance with the required infrastructure improvements; and WHEREAS, the Building and Community Development Director has determined that, with the exception of final documents concerning property owners' stormwater pond and trail maintenance obligations, and property owners' hold harmless and indenmification obligation to the City, the proposal is in conformance with the preliminary plat conditions, is consistent with Chapters 18.16 and 18.24 of the PTMC, and complies with applicable environmental mitigation measures; and WHEREAS, the City Council has reviewed the proposal and concurs with the Building and Community Development Director's determination NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port Townsend APPROVAL of the Hensel Subdivison Final Plat and hereby directs staff to facilitate recording of the plat with the County Auditor once final documents concerning property owners' stormwater pond and trail maintenance obligations, and property owners' hold harmless and indemnification obligation to the City, in form acceptable and approved by the City Attorney in consultation with the Directors of Public Works and Building and Community Development, have been executed and are ready for recording.
