HomeMy WebLinkAbout03-034Resolution No. 03-034 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH JEFFERSON COUNTY FOR CERTAIN LAW AND JUSTICE SERVICES FOR BUDGET YEAR 2004 The City Council of the City of Port Townsend, Washington resolves as follows: WHEREAS, Chapter 39.34 RCW permits local governmental units to make official use of their powers enabling them to cooperate with other localities on the basis of mutual advantage; and WHEREAS, the City and the County agree that providing certain services on a regional basis will provide more efficient, effective, and less costly services for citizens within both the City and unincorporated portions of the County, thereby better serving the public; and WHEREAS, these regional services are in addition to statutory services provided by Jefferson County, as a political subdivision of the State, on behalf of all the citizens of the County funded by County property taxes levied on properties within Port Townsend, and WHEREAS, the City Council desires to make all good faith efforts to fund these services provided in this Resolution in the full amount listed below and shall notify the County in writing as soon as reasonably and practicably possible if and when it finds it cannot. WHEREAS, the City adopted Resolution 99-076 and the County adopted resolution 96-99 declaring an "Intent to Facilitate and Examine Joint Ventures of Common Service Programs Jointly with City of Port Townsend"; and WHEREAS, it is the goal of the City and County to serve their citizens by providing such regional type services on an equitable cost basis; and WHEREAS, the City and the County have the technical and professional expertise to provide services described in this Resolution. WHEREAS, the City Council desires by this Resolution to authorize the City Manager to execute an agreement or agreements with the County for provision of certain regional services as provided for below. NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port Townsend that the City Manager is authorized to execute an agreement or agreements consistent with the requirements of the Interlocal Cooperation Act, Chapter 39.34 RCW, and 1 Res. 03-034 in form approved by the City Attorney, with Jefferson County for the provision of regional services for the following law and justice services for budget year 2004, as follows: Municipal Court Services, in the amount of $94,261, the funding of which is based on previous years Municipal Court criminal and infraction caseload as a percentage of total caseload of the Jefferson County District Court. This service includes public defense and probation services. The formula is total program costs (including cost allocated overhead), less State and Federal grants distributed by the percent of case load activity between City residents and residents in the unincorporated area. The amount of program costs distributed to the City is the City's share of this regional service. All fines and forfeitures generated by City residents shall be deposited with the City. Jail Services, $66,570 for jail services and $23,000 for medical for jail services, for persons booked or held by the County's Correction Department as a result of City misdemeanor or gross misdemeanor law enforcement or criminal justice activity for which the City is legally responsible for under applicable state law, health care costs associated with said incarcerated persons. For persons with multiple warrants, the City should pay according to the days the person is held on the City warrant(s). Such agreement(s) shall provide, among other things, that each party agrees to defend, indemnify, and hold harmless the other from any claims resulting from such party's sole negligence, and that the agreement shall be subject to cancellation on 90 days notice.
