RESOLUTION NO. 18-049
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, AUTHORIZING THE CITY MANAGER TO EXECUTE A QUIT
CLAIM DEED TO RELEASE CITY INTEREST IN JEFFERSON COUNTY TAX
PARCEL NUMBER 001-094-002
WHEREAS, by the Statutory Warranty Deed recorded on April 15, 1999 under
Assessor's Filing Number 422000, the City of Port Townsend required a fifty -foot transition
zone between the Sims Way forest corridor and the commercial development on what is now
Jefferson County tax parcel number 001-094-002, prohibiting clear -cutting of existing timber in
that transition zone; and
WHEREAS, the City of Port Townsend currently owns Jefferson County tax parcel
number 001-094-021, adjacent to tax parcel number 001-094-002, and maintains it as a forest
corridor; and
WHEREAS, on March 19, 2018, the City Council passed Ordinance 3195, authorizing
the City Attorney to begin actions necessary to appropriate real property south of Highway 20
and east of Mill Road for the Howard Street regional stormwater project; and
WHEREAS, the purchase of the property requires that the City grant or retain an
easement to adjoining property owners, and the adjoining property owners have agreed to a
reduced easement area in exchange for a removal of the buffer on Jefferson County tax parcel
number 001-094-002; and
WHEREAS, to continue negotiations to acquire property for the regional stormwater
project and move forward with the project, staff recommends recording a quit claim deed to
release all interest that the City may have in Jefferson County tax parcel number 001-094-002;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend that the City Manager is authorized to execute a quit claim deed releasing all interest
that the City of Port Townsend may have in the real property known as Jefferson County tax
parcel number 001-094-002.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting
thereof, held this 17th day of September, 2018.
