HomeMy WebLinkAbout18-030 Giving Notice of Termination of Interlocal Agreements Between the City, County and Olycap relating to Affordable Housing, and Tasking the Ad Hoc Committee on Housing with Negotiating a New Interlocal Agreement Relating to Affordable HousingResolution 18-030 Page I of 2 RESOLUTION NO. 18-030 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON GIVING NOTICE OF TERMINATION OF INTERLOCAL AGREEMENTS BETWEEN THE CITY, COUNTY AND OLYCAP RELATING TO AFFORDABLE HOUSING, AND TASKING THE AD HOC COMMITTEE ON HOUSING WITH NEGOTIATING A NEW INTERLOCAL AGREEMENT RELATING TO AFFORDABLE HOUSING WHEREAS, the City Council of Port Townsend ("City Council") on May 7, 2018 tasked the Ad Hoc Committee on Housing ("Committee") with review of and making a recommendation to Council on the current 2003 and 2005 Interlocal Agreements on affordable housing; and, WHEREAS, the Committee (Councilors Sandoval, Faber, and Howard) met on May 31, 2018. Following Committee review and discussion, and comment by City Manager David Timmons who attended the meeting, the Committee voted (3-0) to approve the following motion: Motion: David Faber moved to recommend to City Council that the City give notice of termination to the County with the intent to renegotiate the interlocal agreements and that City Council task the Committee with being the lead negotiator on the terms of the new interlocal agreements; and WHEREAS, the City Manager recommends giving notice of termination as recommended by the Committee and negotiations to update the existing Interlocal Agreements; and WHEREAS, reasons for the action in this Resolution to update the current agreements include: The 2003 and 2005 agreements were entered into when the recording fees supporting the creation of housing funds were much lower ($10.00) that currently authorized ($62.00); questions have arisen over financial reports and accounting of monies collected; questions have arisen over whether an adopted plan required by state law has been adopted and is currently in place; whether action on OlyCAP's request for proposal for funding has been acted on by the County; and whether a more open process governing funds and access to funds should be in place; and WHEREAS, the City Council determines it appropriate to accept the recommendation of the Committee and City Manager; and WHEREAS, this Resolution does not preclude negotiating a new agreement on affordable housing issues within the 90 -day period following the Notice of termination and its effective date 90 days thereafter. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port Townsend as follows: The City Manger is directed to give notice of termination of two Interlocal Agreements (2003, 2005) relating to affordable housing to the County and OlyCAP, with Notice being given on or around July 1, 2018, and effective 90 Resolution 18-030 Page 2 of 2 days thereafter.. I The Ad Hoc Committee on Housing, in consultation with the City Manager, is tasked with negotiating a new interlocal agreement relating to affordable housing, and to report the results of the negotiations to the City Council for its consideration and action. ADOPTED by the City Council of the City of Port Townsend at a regular meeting thereof, held this 18th day of June, 2018. Attest: .
