AN ORDINANCE VACATING ALL OF BLOCKS 3, 4, AND 6 AND LOTS 9 THROUGH 18
OF BLOCK 5 OF THE PLAT OF SEAVIEW ADDITION TO THE CITY OF PORT
TOWNSEND, EXCLUDING ALL STREET RIGHTS-OF-WAY AND ALLEYS LYING
THEREIN; AND ESTABLISHING AN EFFECTIVE DATE.
Assessor's Parcel Numbers: 993-600-301, 993-600-401, 993-600-506, 993-600-503,
993-600-504 and 993-600-601.
Grantor: City of Port Townsend
Grantee: Whitney Miller, successor trustee of the "53`d Street Trust of February 23,
2000" (Lots 9 - 18 of Block 5 and all of Block 6), and successor trustee of
the "Seaview 53rd Street Trust of August 1, 2001 ° (all of Blocks 3 and 4)
WHEREAS, the Hearing Examiner for the City of Port Townsend has considered a Plat
Vacation request submitted under File No. LUP08-094 by Whitney Miller, and following due
notice has held a public hearing upon the request on January 23, 2009; and
WHEREAS, the Hearing Examiner issued a Findings of Fact, Conclusions of Law and
Decision dated February 6, 2009, approving the Plat Vacation request with two conditions: that
the vacation occur within five years, and the property owner sign the Plat Vacation application if
the owner is not Whitney Miller; and
WHEREAS, no Request for Reconsideration was filed prior to the appeal period which
ended on March 2, 2009, and on that date the owner's designated representative Douglas G.
Mason, Attorney at Law, requested in writing the Ordinance be prepared; and
WHEREAS, according to the Jefferson County Assessor's website the subject property
is still owned by Whitney Miller Successor Trustee of "The 53rd Street Trust" and "The Seaview
53rd Street Trust": and

WHEREAS, the conditions of approval are acceptable to the applicant, who now wishes
to finalize the Plat Vacation.
NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
Section 1. Blocks 3, 4, and 6 and Lots 9 through 18 of Block 5 of the Plat of Seaview
Addition to the City of Port Townsend, excluding all street rights-of--way and
alleys lying therein are hereby vacated in their entirety.
Section 2. This ordinance shall take effect upon its passage, approval and publication in the
form and manner provided bylaw
Adopted by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this twentieth day of Apri12009.
