HomeMy WebLinkAbout1797 Water and Sewer System PlanORDINANCE NO. 1797 AN ORDINANCE of the City of Port Townsend, Washington, adopting a plan for the acquis- ition, construction and installation of certain additions and improvements to and extensions of the water and sewerage system of the city; declaring the estimated cost thereof, and providing for the payment of such cost. WHEREAS, this Council finds that the existing water system of the City of Port Townsend, Washington, (hereinafter called the "City"), should be improved by the acquisition, construction and installation of the hereinafter provided for additions and improve- ments to and extensions of such system; and WHEREAS, in order to pay part of the cost of acquiring, constructing and installing such additions and improvements to and extensions of such system it is deemed necessary and advisable that the City issue and sell its water and sewer revenue bonds in the principal amount of $1,245,000; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Port Townsend, Washington, as follows: Section 1. The City shall construct and install improvements to the water supply and distribution system of the City as follows: The City shall acquire and install water meters throughout the system, shall construct a 5 million gallon reservoir, 14,100 lineal feet of transmission line, a one million gallon per day treatment plant and pump, shall install a one million gallon reservoir and install 30,000 lineal feet of 6", 8" and 10" transmission line to serve the Tri-Cities area and shall clean the Fort Worden reservoir. Such project shall be as more fully set forth in preliminary and final maps, plans, and specifications therefor prepared by Encon, consulting engineers to the City, and now on file with the City. The City shall acquire and install all equipment, lines, valves, fittings, and other appurtenances necessary for the installation, use, and operation of the hereinbefore authorized improvements; and shall acquire by purchase or condemnation, gift or grant, all property, both real and personal or any interest therein, and all easements, rights-of-way and franchises which may be found necessary to carry out the hereinbefore authorized plans. It is hereby provided that the above-described plan of improve- ments shall be subject to such changes as to location and as to size of pipe or in any other details of said plan not affecting the service to be rendered thereby which shall be authorized by the City Council either prior to or during the actual course of con- struction and which shall be found necessary and desirable, so long as the same do not affect or change the main general features of said plans as above set forth. Section 2. The estimated cost of acquiring, constructing and installing the above-provided for plans of additions and improve- ments to the existing system of the City is hereby declared to be, as near as may be, the sum of $3,130,000, approximately $1,885,000 of which will be provided from anticipated grants from the United States and the State of Washington. The remaining amount of such cost shall be provided from available monies of the City and from the proceeds of sale of water and sewer revenue bonds of the City in the principal amount of $1,245,000, or so much thereof as is determined to be necessary by the City Council. As an integral part of the plan of acquiring, constructing, and installing the above-provided for additions, improvements, and extensions the City shall issue and sell such water and sewer revenue bonds in such amount or amounts and at such time or times as this Council may determine to be to the best interest of the City and its inhabitants. The exact date or dates, form, terms, maturities and covenan~ ts of such bonds shall be as hereafter fixed by ordinance or ordinances of the City. -2- Section 3. There is hereby created a special fund of the City to be known as the 1978 Water Construction Fund (the "Con- struction Fund"). All of such grants and all other monies avail- able for payment of the cost of the above-described facilities and the proceeds of the sale of such bonds shall be paid into the Construction Fund. All costs of such facilities shall be paid out of such fund. When there are insufficient monies on hand in the Construction Fund to pay approved costs of such facilities, warrants in payment thereof shall be drawn on such fund, marked "not paid for want of funds" and registered by the City Treasurer. Said warrants shall bear interest from date of registration at such rate as shall be determined by the City Treasurer based upon negotiation or competitive bid. Such warrants shall be redeemed in order of their number out of the first monies next on hand and available in said fund.
