Every ac~ ~a~fu~y done and every omission ~o perfo~ a duty, which act or omission (1) Shall ~noy, injure or endanger ~e saftey, heal~, or repose of any considerable nu~er of persons~ or, (2) Shall offend p~lic ~ecency~ or, (3) Shall ~lawfully in~rfere wi~, befoul, ~t~ct, or mender dangerous for passage, a lake, pon~, bay or basin, or a p~lic par~, square, street, alley or highway~ or, (4) Shall in any way render a considerable n~er of ~rsons insec~e in life or the use of property~ Shall be a p~lic nu~eance, an~ shall be p~ishable as a mi sde~anor. Section 2. ~ act which affects a considerable n~ber of persons in ~y of the ways specified in Section 1 hereof is not less a public nuisance because ~e extent of da~ge is ~ne~al. Secti~ 3. Every pers~ ~o shall co,it or ~intain a public ~uisance, for.which no special 9~iSh~nt is prescri~ or who ~all w~~yomit or refuse to perform ~y legal ~uty relating to the removal of such nuisance~ .an~ every person ~o shall let, or ~rmit to be use~, ~y ~l~ing or b~t, or portion thereof, kn~ing ~at it is in~nded to be, or is being used, for ~itting or maintaining any such nuisance, shall be quilty of a ~sdemeanor. Section 4. ~y court or ~gistrate ~fore whom ~ere ~y be pending any proceeding for ~e violation of any of ~e provisions '~O~~ t~ ~°~inance, in a~dition to any fine or o~e~ punis~nt which it ~y impose for such violation~A0rder such ~uisance abated. -1- Section 5. This ordinance shall take effect upon its passage approval and publication in the form and manner required by la~. Read for the first time April 18, 1978.
