AN ORDINANCE PROVIDING FOR INSTALLATION OF UTILITIES BY SUBDIVIDERS, AND PROVIDING FEES AND PROCEDURES THEREFOR WHEREAS, it has become apparent that it is desirable that the d~elopers of subdivisions and planned unit developments should, in some cases, install utility lines as a part of the development, and WHEREAS, existing ordinances require City installation of certain utilities, without exception for subdivision or planned unti development situations, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1. Notwithstanding the provisions of prior ordinances in conflict herewith, the appropriate department head, r~sponsible for the utility involved, may grant to any person, firm or entity develop~ngtand establishing a new subdivision or planned uni~ developmen~ permission to install at the expense of the developer the ~utility in question, which permission shall be effective only if in writing. Section 2. Each application for permission to install any utility, pursuant to the prvisions hereof, shall be accompanied by plans and specifications acceptable to the department head involved, and which must be approved by said department head prior to the granting of the permission herein permitted. Section 3. Any installation of utilities accomplished pursuant to the terms of this ordinance shall be subject to the inspection and approval of the appropriate department head, and no use shall be made of such installation until such approval is given in writing. Section 4. Fees for the utilties herein mentioned shall be paid on the basis of current schedules, excepting that in the casl~.water line installations the fee shall be $~00.~00, to cover the right of connection and the cost of approval and inspection. -1- Section 5. Any utility installation made pursuant to the terms hereof shall be done only with the approval of the Street Superintendent, insofar as any such utlities may be located in City streets or parking area, or other areas for which the city Street Department bears the responsibilit~ of maintenance. Section 6. This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by ~aw.
