Ordinance 3181
AN ORDINANCE OF THE CITY OF PORT TOWNSEND RELATED TO THE
DESIGNATION OF CITY RIGHTS-OF-WAY; RE -DESIGNATING PARTS OF THE
HOWARD STREET RIGHT OF WAY AS RAINIER STREET
WHEREAS, RCW 35A.11.020 grants the City the authority to regulate public ways;
and,
WHEREAS, the Plat of Swan Park, dated August 8, 1889 dedicated 30 feet of right-of-
way between 6th Street and 10th Street as "Howard Street" (Exhibit B); and,
WHEREAS, the Plat of National City Addition No. 1, dated November 8, 1927
dedicated 60 feet of right-of-way along the west edge of the plat as Howard Street (Exhibit C);
and,
WHEREAS, the Plat of the Port Townsend Business Park Planned Unit Development,
dated September 23, 1994 re -dedicated 30 feet of right -of way between the north edge of the
National City Addition and 10th Street as "Howard Street" (Exhibit D); and,
WHEREAS, the Plat of The Phillips Addition, dated April 16, 1889, dedicated 68 feet of
right-of-way between 10th Street and 15th Street as "Howard Street" (Exhibit E); and,
WHEREAS, the Plat of Glenwood Addition, dated August 22, 1889, dedicated 60 feet of
right-of-way between 10th Street and 15th Street as "Rainier Street" (Exhibit F); and,
WHEREAS, as part of its Howard Street project, the City designed the travel corridor so
that it begins in the Howard Street right-of-way at Sims Way, but between the 6th Street and 7th
Street right of way it transitions to the northwest, with its final alignment in the Rainier Street
right-of-way; and,
WHEREAS, the Howard Street right-of-way is preserved for use as a utility corridor and
a "backage" road for developments that will front on the new travel corridor and there are
existing residences on the Howard Street right-of-way; and,
WHEREAS, north of 10th Street the Howard Street right-of-way currently is a residential
neighborhood; and
WHEREAS, staff has recommended renaming the entire travel corridor, as well as the
Howard Street right-of-way south of Sims Way to the City limits to "Rainier Street"; and,
WHEREAS, the City Council concurs with staff's recommendations.

NOW, THEREFORE, the City Council of the City of Port Townsend do ordain as
follows:.
Section 1. Re -designation of portion of right -of -why,. That part of the Howard Street
right-of-way from the northern -most edge of the 7 t Street right-of-way south to the City limits,
as shown on Exhibit A is re -designated "Rainier Street."
Section 2. Classification of portion of right of Nom, If any part of the Howard Street
right-of-way from the northern -most edge of the 7th Street right-of-way north to 10'h Street is
opened for vehicular traffic, that travel way shall be considered an "alley" as defined in Section
12.04.030A of the Port Townsend Municipal Code. Unless specifically approved by the Public
Works Director, no vehicular travel way shall exceed 20 feet in width. The alley will not be
named, and it shall only be used as secondary access to the properties fronting on Rainier Street.
Section 3. Severability. If any provision of this ordinance or its application to any person
or circumstance is held invalid, the remainder of the ordinance, or the application of the
provision to other persons or circumstances, is not affected.
Section 4. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
Section 5. Effective Date. This Ordinance shall take effect and be in force five days
after the date of its publication in the manner provided by law.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting
thereof, held this 5the day of September, 2017. ,-1
