AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING PORT
TOWNSEND MUNICIPAL CODE CHAPTER 17.72, ESTABLISHING AN OFF-STREET
PARKING REQUIREMENT FOR RESIDENTIAL USES 1N THE C-III PORTIONS OF
THE UPTOWN NATIONAL LANDMARK HISTORIC DISTRICT AND RESCINDING
THE PROVISIONS OF ORDINANCE 2984 WHICH REENACTED AND EXTENDED
INTERIM PARKING REGULATIONS FOR RESIDENTIAL USES IN THE UPTOWN
COMMERCIAL DISTRICT
WHEREAS, the commercial districts located within the National Landmark Historic District
are developing and redeveloping to accommodate increased residential development in mixed-use
structures; and
WHEREAS, the Port Townsend Comprehensive Plan was adopted to provide guidance for
the community on accommodating growth and redevelopment in commercial districts in a manner
that respected the natural and built environment and enhanced the community; and
WHEREAS, Comprehensive Plan Policy 7.6 requires property owners to provide parking
and manage parking demand generated by their properties to avoid spill over parking on neighboring
properties and streets; and
WHEREAS, Title 17 (Zoning) of the Port Townsend Municipal Code was adopted to fully
implement the Comprehensive Plan; and
WHEREAS, the lack ofoff-street residential parking requirements as currently found in
PTMC Title 17 for the Uptown Commercial district does not adequately provide relief from on-street
parking demands; and
WHEREAS, the City Council adopted Ordinance 2928 (September 5, 2006) providing for
interim parking regulations which required off-street parking for new residential development in the
Uptown commercial district, and extended said regulations by Ordinance 2942 (February 20, 2007)
,Ordinance 2950 (August 20, 2007), Ordinance 2968 (February 4, 2008) and Ordinance 2984
(August 4, 2008); and
WHEREAS, the Uptown Parking Strategies Committee was appointed by Council on
September 17, 2007. The Committee met on October 24 and November 13, 2007 and on January 15
and February 6, 2008; and
WHEREAS, at their February 6, 2008 meeting the Uptown Parking Strategies Committee
recommended that an off-street parking requirement be re-established in the Uptown commercial
district; and

WHEREAS, the Council and Planning Commission held a joint workshop meeting on
March 13 to review the recommendation; and
WHEREAS, the Planning Commission considered in workshop session the need for
revisions to Title 17 to address the identified off-street parking requirement; and
WHEREAS, a residential off-street parking requirement has been proposed to ensure that
adequate parking is provided; and
WHEREAS, the Planning Commission held a noticed Public Hearing on the proposed
revision on June 26, 2008. At their July 10, 2008 meeting, the Commission considered public
comment received, reviewed the record and b}' a vote of 5 in favor and 2 opposed recommended
approval of the proposed revisions; and
WHEREAS, environmental review was previously conducted consistent with the
requirements of the State Environmental Policy Act (Chapter 43.21 C RCW) resulting in the adoption
of a Detetrnination of Non-significance that was issued on March 14, 2005; and
WHEREAS, pursuant to RCW 36.70A.106, the City of Port Townsend provided notice of
intent to adopt and requested expedited state agency review of the proposed development regulation
or amendments; and
WHEREAS, the City of Port Townsend was granted expedited review by the state agency
with jurisdiction on August 6, 2008,
NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows:
SECTION 1. Untown C-III Commercial District Residential Parkine Requirements. Section
17.72.020 PTMC is hereby amended, and shall read as follows:
B. Exemption -National Register Historic Overlay District. All new construction and all
land uses established, changed or relocated within the nonresidential zoning districts of the
historic overlay district, as defined by PTMC 17.30.040 , excentine for the C-III zoned
roortions of the Untown National Landmark Historic District. shall be exempt from off-street
parking and loading requirements; provided, that the owner of the property underlying such
construction or uses has first signed a no protest agreement with the city, in a form approved
by the city attorney, concerning the formation of a parking and business improvements
district (PBID) fox the purpose of funding municipal parking facilities, pursuant to Chapter
35.87A RCW; and further provided, that all such construction and uses shall be subject to the
maximum permissible parking space and bicycle parking requirements set forth in Table
17.72.080; and provided further, if parking facilities are provided, they must meet the
requirements established pursuant to PTMC 17.72.150 through 17.72.190 regarding parking
plan requirements, minimum dimensions, landscaping, and maintenance.

SECTION 2. TABLE 17.72.080 PTMC is hereby amended, and shall read as follows:

SECTION 3. Severabilitv. If any sentence, clause or phrase of this ordinance should be held to be
invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect the validity or constitutionality ofany other section, sentence, clause or phrase or
work of this ordinance.
SECTION 4. Rescind Ordinance 2984. The provisions of Ordinance 2984 which reenacted and
extended interim parking regulations fox residential uses in the Uptown Commercial District shall be
rescinded concurrent with the effective date of this Ordinance.
SECTION 5. Effective Date. This Ordinance shall take effect immediately after passage if adopted
by a majority plus one of the City Council. Otherwise this ordinance shall take effect and be in force
five days afer the date of its publication in the manner provided by law. Publication of this
ordinance shall be by summary thereof consisting of the title.
ADOPTED by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this first day of December, 2008.
