AN ORDINANCE AMENDING
ORDINANCE NO. 1868
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
IN REGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS
Section 1. Section 2 of Ordinance No. 18~8 is
hereby amended to provide as follows:
"Section 2. This ordinance shall be effective only
upon the proper recording of the covenants presented by the
petitioner, Jefferson County Public Hospital District No. 2,
in connection with the rezone approval by Ordinance No. 1868,
as said covenants are amended by the proposals presented at
the public hearing of this date, which covenants as amended,
inter alia, restrict the property to use for physicians'
and osteopaths' offices and to limited use by dentists,
and further require architecture compatible with R-I zoning."
Section 2. This ordinance shall take effect upon its
passage, approval and publication in the manner required by
law.

ADMENDMENT TO COVENANTS
WHEREAS, certain covenants have he[etofore been imposed upon
real estate in Jefferson County,.Washington, described as:
All of Block 193 of the Eisenbeis
Addition to the City of Port Townsend;
and
WHEREAS, the said real estate has been acquired by James P.
McCarron, William Bloemker, John C. Rowe, J. Peter Geerlofs and
J. Randall Jacobs, each of whom has some property interest therein
and is subject to the said covenants, and
WHEREAS, The City of Port Townsend and Jefferson County Public
Hospital District No. 2, each a municipal corporation, are likewise
parties to said covenants, and
WHEREAS, the said City of Port Townsend and Hospital District
haVe accomplished procedures appropriate to amend said covenants,
and the individual owners consent thereto, now, therefore, be it
remembered that
Those certain covenants recorded in Volume Official
Records pages , and dated , 1981, are amended,
as to "Use of Premises," to read as follows:
"Use of Premises:
Excepting that grantor Hospital District may establish, operate
and maintain structures for any hospital or health care purpose,
there shall be no use made of the premises excepting for the private
practice of medical doctors, including doctors of osteopathy,
licensed as such by the State of Washington, provided, however, that
a portion of the premises may be used for the private practice of
dentist~ry, licensed by the State of Washington, on the following
conditions:
a. During the first five years of building occupancy, not
more than 50% of the total planned building space will
be used for the private practice of dentistry.
b. During the first five years, a portion of the builc~inc
space shall be used for the private practice of med~leine.
c. At the end of the first five years of any building
occupied, medical doctors shall utilize at least ~

be the free and voluntary act and deed of said municipal corporation,
for the uses and purposes therein stated, and oath stated that they
were authorized to execute the said instrument and that the seal
affixed 'is the seal of said municipal corporation.
