THE CITY COUNCIL OF THE CITY OF PORT TO, SEND, IN ~GUL~R SESSION
~SSEMBSED, DO O~D~IN ~S FOL5OWS:
Section 1. That portion of Lawrence S~ee~ lying between
Kearney S~ree[ and Decatur S~reet is hereby vacated, subject ~o ~he
following conditions:
(a) That ~he applican~ shall convey Eo the Ci[y, by
dedication ~hereo[ [o~ City pa~k purposes,
h~ac~ so indicated upon ~he survey map p~esen~ed
by the applicant, Kah Tai Car~ Center, a~ the public
hearing on said vacation held on September V, 1982,
which conveyance shall be completed within sixty (60)
days ff~om final approval of the Shorelines Management
substantial developmen~ pe~mi~ which is now pending on
appeal, or ~ihhin sixty {~0) days off ~he comple[ion
any litigation affecting ~he matter.
(b) Tha~ if ~he expansion project, ~ep~esen~ed ho be desired
by the applicant in connection with ~he application for
s~reeE vacation, is no~ comp~ed within six {6) years
[rom ~he da~e he~eof, ~he vacation ~ill be automatically
~evoked, withou~ further City Council action.
(c) That ~he applican~ shall ~elocahe any drainage lines
other u~ili~ies which may be disturbed by ~he p~ojec~
p~oposed by applicant, a~ applicant's sole expense.
Tha~ ~he City reserves in the vacated s~ree~ an easement
ffo~ wa~er lines, sewers and o~her u~ility lines.
Section 2. This ordinance shal~ ~ake effec~ upon i~s passage,
approval and publication as provided by la~.
