HomeMy WebLinkAbout1932 Rezoning and Amending the Official Zoning MapAN ORDINANCE REZONING THAT PORTION OF THE SOUTH 412.5 FEET OF THE SOUTHWEST QUARTER, SECTION 9, TOWNSHIP 38 NORTH, RANGE 1 W.W.M., LYING BETWEEN THE EASTERLY RIGHT-OF-WAY LINE OF DISCOVERY ROAD (COUNTY ROAD NO. 38), THE WESTERLY RIGHT-OF-WAY LINE OF OF STATE ROAD NO. 9, AND THE NORTH RIGHT-OF-WAY LINE OF GLEN COVE TIE ROAD (COUNTY ROAD NO. 316); EXCEPT THAT PORTION DEEDED TO THE CITY OF PORT TOWNSEND BY DEED RECORDED UNDER AUDITOR'S FILE NO. 167453, FROM P-I TO C-II AND ~4ENDING THE OFFICIAL ZONING MAP. WHEREAS, due hearing has been held, and appropriate findings made, as provided by Ordinance No. 1625, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1. The official map of the City is here and hereby amended to change from P-I zoning to C-II zoning those lands in Port Townsend described as follows: That portion of the South 412.5 feet of the Southwest Quarter, Section 9, Township 30 North, Range 1 W.W.M., lying between the Easterly right-of-way line of Discovery Road (County Road No. 38), the Westerly right-of-way line of State Road No. 9, and the North right-of-way line of Glen Cove tie road (County Road No. 316); EXCEPT that portion deeded to the City of Port Townsend by deed recorded under Auditor's File No. 167453, records of Jefferson County. Section 2. The ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law. J DIRECTIVE AS TO COVENANTS BE IT REMEMBERED that in passing ordinance No. ;q~-z- , on November 2, 1982, the City Council approved and passed said ordinance only upon condition that the applicant for the rezone therein provided should execute and record, in favor of the public and the City of Port Townsend, covenants providing: (1) Access to the property rezoned shall be from Discovery Road only, and not from Sims Way; and (2) A green belt, consisting of existing trees, shall be preserved on the West boundary of the rezoned property, extending from a line extended from the City entrance sign West of the property, fifty feet Easterly on the South boundary along Sims Way, and twenty-five feet Easterly on.the North boundary along Discovery Road; the object and purpose being to provide a greenbelt background for the City entrance sign, which belt will be 50 feet wide on the South end and 25 feet wife on the North end. The aforesaid ordinance shall not be published until the covenants herein required have been approved by the City Council and recorded with the Jefferson County Auditor at the expense of the applicant.
