HASTINGS ADDITION; ESTABLISHING CONDITIONS TO THE STREET VACATION: AND ESTABLISHING AN EFFECTIVE DATE Reference Documents: Lot Line Adjustment Statement of Intent, AFN .J~ S~eQ Record of Survey, AFN ~3 ~,~ a ] Grantor: City of Port Townsend Grantees: Quimper Unitarian Universalist Fellowship Assessor's Parcel Numbers: 958-501-301 & 958-502-301 WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation Application No. LUPOS-078 and following due notice held a public hearing on the application; and WHEREAS, the vacation request involves a section of 23`d Street lying between Block 13 and Block 23 of the Supplemental Plat of O.C. Hastings Addition. The right-of--way segment is approximately 150 feet in length and 66 feet in width; and WHEREAS, the City Council for the City of Port Townsend separately adopted Findings of Fact and Conclusions concerning the street vacation on December 13, 2005; and WHEREAS, the CounciFs Findings and Conclusions approved in concept the proposed vacation subject to petitioners paying for an appraisal of said right-of--way and Page I qf3 Ordinance 299? paying 100% of the appraised value of the land, less any appraised value assigned to reservation of a 20-foot wide public utility and non-motorized easement; and WHEREAS, the Council's Findings and Conclusions also conditioned final vacation approval upon petitioners obtaining a Conditional Use Permit for the planned expansion of the church that would occur partially within the vacated right-of-way and a submittal of a building permit for the planned expansion. Council's Findings and Conclusions also required the applicant to submit a Lot Line Adjustment application to merge the vacated street into petitioner's adjoining lands; and WHEREAS, petitioners have now paid full appraised value of the subject right-of-way to the City, have obtained approval of the Conditional Use Permit, have submitted a substantially complete building permit, and have submitted a Lot Line Adjustment application, which has been processed and preliminarily approved by the DSD Director subject to final City Council approval and recording of the alley vacation Ordinance, NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: Section 1. Subject to the conditions in Section 2 of this Ordinance, the following right-of- way is hereby vacated to Quimper Unitarian Universalist Fellowship. That portion of the 23rd Street right-of-way wide lying between Blocks 13 and Block 23 of the Supplemental Plat of O.C. Hastings Addition to the City of Port Townsend according to the plat thereof recorded in Volume 2 of Plats, page 34, records of Jefferson County, Washington. Section 3. Vacation of the aforementioned right-of-way is conditioned on the following: a. Petitioners shall adhere to all conditions of their Lot Line Adjustment and Conditional Use Permit approvals, which received preliminary approval by the City DSD Department on September 22, 2008 (File No. LUP08-078) and July 21, 2008 (File No. LUP08-035). The Lot Line Adjustment merges the vacated right-of-way into petitioners adjoining lands via the filing of a Record of Survey and a Statement of Intent. The Record of Survey and Statement of Intent shall be filed with the Jefferson County Auditor concurrently with the recording of this street vacation Ordinance. The petitioners shall pay for all fees associated with recording the above documents. Section 4. This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor pursuant to Section 2 of this ordinance.
