HomeMy WebLinkAbout1960 Rezoning and Amending Official Zoning MapORDINANCE NO. ~ AN ORDINANCE REZONING BLOCK 209, LOTS 1,2,3,4, OF THE EISENBEIS ADDITION AND PROVIDING CONDITIONS THEREFORE THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1. Subject to the conditions set forth in Section 2 hereof, the official zoning mad of the City of Port Townsend is here and hereby amended to the extent that Block 209, Lots 1,2,3, and 4 of the Eisenbeis Addition to the City of Port Townsend shall henceforth be "R-III" zone. Section 2. This ordinance shall be effective only upon the proper recording of the covenants presented by the petitioner Doctor Richard Lynn, in connection with his application for rezone, which covenants, inter alia, restrict the property to use for private practice of medical doctors (including doctors of osteopathy), doctors of dentistry and readily identifiable medical or dental support facilities such as pharmacies or medical/dental laboratories which may be included as accessory uses within the same building, but not to exceed 50% of the total building space. That no structure shall be erected upon the premises of an architectural design that is not compatible with the residential character of the neighborhood, or which exceeds the height limitations established for any abutting property by City of Port Townsend Ordinances. Off street parking areas in conformity to City zoning requirements for physicians' offices shall be established on the premised and surfaced, and shall be maintained in good condition thereafter. Landscaping shall be provided and maintained in a tasteful manner consistent with a residential area. Violations of these covenants may be remedied by payment of damages, by the assessment of damages to cover costs of remedying such breach and all fees and charges thereto pertainlng These covenants shall run with the land and may be enforced by the City of Port Townsend. Section 3. If no construction is started upon the property within-one year from the date hereof the zoning of said property shall revert to "R-II~'. Section 4. This ordinance shall take effect upon its passage, ~approval and publication as required by law. Read for the first, second and third times and approved by the Mayor on ~4~ I~ /~.
