AN ORDINANCE OF THE CITY OF PORT TOWNSEND, WASHINGTON,
RELEASING A UTILITY EASEMENT (AT 57TH AND LANDES STREETS) AND
AMENDING ORDINANCE 1783, VACATING PORTIONS OF GARFIELD, SCOTT,
GAINES, LANDES AND 2ND STREETS
WHEREAS, Ordinance 1783, adopted June 7, 1977 vacated that portion of Landes
Street lying between 57th Street and 58th Street. Ordinance 1783 reserves an unspecific easement
for the construction and maintenance of water, sewer, and other utilities; and,
WHEREAS, one of the abutting property owners has asked the City to reduce the width
of the easement consistent with PTMC 12.30; and,
WHEREAS,after review of the request, the Public Works Director has determined that
this vacated right of way is not needed for utility purposes, now or in the future, and
recommends release of the utility easement;
NOW, THEREFORE,the City Council of the City of Port Townsend do ordain as
follows:
Section 1. Section 1.4 of Ordinance 1783 is amended to read as follows:
4. That portion of Landes Street lying between 57th Street and 58th Street.
Provided that no easements are rescrved over the vacated portion of Landes
Street.
Section 2. The City Manager is authorized to execute a release of utility easement and to
record the same.
Section 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
Section 4. Effective,Date. This Ordinance shall take effect and be in force five days
after the date of its publication in the manner provided by law.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting
thereof, held this 5th day of December, 2016.
