HomeMy WebLinkAbout2015 Peddlers, Solicitors and CanvassersORDINANCE NO. ~}~ AN ORDINANCE REGULATING PEDDLERS, SOLICITORS AND CANVASSERS, PROVIDING FOR ENFORCEMENT AND PENALTIES FOR VIOLATIONS THE CITY COUNCIL FOR THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED DO ORDAIN AS FOLLOWS: Section 1. Definitions (a) The work "person" as used herein shall include the singular and the plural and shall also mean and include any person, form or corporation, association, club or partnership, society, or any other organization except as otherwise pro- vided in this ordinance. (b) The work "peddler" as used herein shall include any person, whether a resident of the City of Port Townsend or not, travelling by foot, wagon, automotive vehicle, or any other type of conveyance, from place to place, from house to house, or from street to street, carrying, conveying or trans- porting goods, wares, merchandise, meats, fish~, vegetables, fruits, garden truck, farm products or provisions, magazines, peridocals or other personal property, offering and exposing the same for sale, or making sales and delivering articles to purchasers, or who, without travelling from place to palce shall sell or offfer the same for sale from a wagon, automotive vehicle, or any other vehicle or conveyance,and further provided, that one who solicits orders and as a separate transaction makes deliveries to purchasers as a part of a scheme or design to evade the provisions of this ordinance shall be deemed a peddler subject to the provisions of this ordinance. The work "peddler" shall include the woldS "hawker" and "huckster." (c) A "Canvasser" or"Solicitor" is defined as any<'individual whether resident of the City of Port Townsend or not, either travelling by foot, wagon, automobile, motor truck, or any other type of conveyance, from place to place, from house to house or from street to street, taking or attemptint to take orders for the sale of goods, wares , merchandise, or personal property of any nature whatsoever, including but not limited to those items descrimd in subsection (b) of this section, for future delivery, or for services to be furnished or performed in the future, whether or not such individual has, carries or exposes for sale a sample of the subject of such sale or whether he is collecting advance payments on sucy sale or not, provided, that such definition~shall not include any person who, for himself or for another person, firm or corporation, hires, leases, uses or occupies any building, structure, tent, boat, hotel room, lodging house, apartment, shop or any other place withint the City for the sole purpose of exhibiting samples and taking order for future delivery from such place. (d) "City" shall mean the City of Port Townsend. Section 2. Enforcement ~.~ ..... ~Shall be the duty of any police officer of the City to enforce the provisions of this ordinance against any per~0n fouhd to be violating the same. Section 3. Unlawful conduct. Peddling, soliciting or canvassing as defined in this ordinance at a private residence or residences in the City without a request or invitation in advance to do so by the ower or oc- cupant of such private residence, for the purpose of the sale or the soliciation of orders for the sale of any goods, products, services, or personal property, including b6t not limited to all items listed in Sections l(a) and (b) of this Ordinance, is unlawful. Section 4. Penalties Any person violating this ordinance shall be guilty of a misdemeanor and shall be punished by imprisonment in jail for not more than ninety days or by a fine of not more than One Thousand Dollars, or by both such fine and imprisionment. Section 5. Severabi!~ty If any provision or part of this ordinance is for any reason helb to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance, but~' they shall remain in effect. Section 6. Effective Date This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law. Read for~the fist, second and third times, passed by the City Council of Port Townsend and approved by the Mayor on this 16th day of July, 1985.
