AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING PTMC
SECTION 17.72.020 AND RE-ENACTING AND EXTENDING INTERIM
PARKING REGULATIONS FOR RESIDENTIAL DEVELOPMENT IN THE
UPTOWN C-III COMMERCIAL DISTRICT ADOPTED BY ORDINANCE 2968
WHEREAS, the City Council adopted Ordinance 2928 (September 5, 2006)
providing for interim parking regulations which required off-street parking for new
residential development in the Uptown commercial district, and extended said regulations
by Ordinance 2942 (February 20, 2007) and Ordinance 2950 (August 20, 2007), and
Ordinance 2968 (February 4, 2008), and
WHEREAS, the establishment of interim standards requiring off-street parking
for residential development in the Uptown commercial district allows for the timely
review and clarification ofoff-street parking regulations such that the appropriate scale,
character and function of the district can be preserved; and
WHEREAS, a planning process is underway to review parking regulations in the
Uptown commercial district, including, formation and review of parking requirements by
an ad-hoc parking committee review process identified as an outcome by the Uptown
Charette (January 17, 2007), and in a presentation by the City's consultant Maker's to the
City Council on January 29, 2007, and Maker's recommendation for additional planning
efforts. The Council appointed Councilor Masci as the Council member for an advisory
committee on Uptown parking issues. The City solicited committee members (with some
difficulty due to potential member scheduling and time commitment issues), and the
Council will separately be appointing citizen committee members; and
WHEREAS, the Uptown Parking Strategies Committee was appointed by
Council on September 17, 2007. The Committee met on October 24 and November 13,
2007 and on January 15, 2008. It is anticipated that the Committee will complete its
recommendation at this meeting. A joint Council/Planning Commission workshop
meeting has been tentatively scheduled for March 13 to review the recommendation.
WHEREAS, the City Council has received public comment on this issue as
required by law; and
WHEREAS, the City needs additional time to consider properly and carefully the
potential effects of development and parking regulations, and to allow the processes
identified above and already underway to provide recommendafions to the Planning
Commission and City Council; and
WHEREAS, the City Council finds it is appropriate to preserve the status quo
and to prevent the vesting of any new applications for development or land use approvals

that are or may be inconsistent with the City's comprehensive plan or the outcome of the
pending Uptown planning effort; and
WHEREAS, RC W 35A.63.220 relating to Code cities like Port Townsend and
36.70A.390, a section of the Growth Management Act (Ch. 36.70), authorizes the City to
adopt interim regulations to preserve the status quo while new plans or regulations aze
considered and prepared.
WHEREAS, the Planning Commission has now completed its review (July,
2008). A public hearing on their recortunendation will take place sometime in
September/October. Recommendation to CTED for GMA-mandated concurrence review
has been submitted. A pazking survey is being finished. Based on the above, an
extension of the interim regulation is appropriate.
NOW, THEREFORE, the City Council of the City of Port Townsend ordains
as follows:
SECTION 1. EXTENSION AND REENACTMENT. For the reasons set
forth in the Recitals (above), which are hereby approved, those provisions enacted by
Section 6 of Ordinance 2929 (September 5, 2006), and set forth below, are hereby re-
imposed, re-enacted, extended and continued in existence for six months from the
effective date of this Ordinance or until parking regulations for the Uptown C-III
Commercial District are adopted by the City Council, whichever is sooner.

existing provisions of the PTMC):
SECTION 6 of Ordinance 2929. Uptown C-III Commercial District Parking
Requirements. Section 17.72.020 PTMC is hereby amended, and shall read as follows
(strike-out is deleted, underline is added):
B. Exemption -National Register Historic Overlay District. All new construction
and all land uses established, changed or relocated within the nonresidential
zoning districts of the historic overlay district, as defined by PTMC 17.30.040 ,
excentine fox the C-III zoned nortions of the Untown National Landmark Historic
District. shall be exempt from off-street parking and loading requirements;
provided, that the owner of the property underlying such construction or uses has
first signed a no protest agreement with the city, in a form approved by the city
attorney, concerning the formation of a parking and business improvements
district (PBID) for the purpose of funding municipal parking facilities, pursuant to
Chapter 35.87A RCW; and further provided, that all such construction and uses

shall be subject to the maximum permissible parking space and bicycle parking
requirements set forth in Table 17.72.080; and provided further, if pazking
facilities are provided, they must meet the requirements established pursuant to
PTMC 17.72.150 through 17.72.190 regarding parking plan requirements,
minimum dimensions, landscaping, and maintenance.
TABLE 17.72.080 PTMC is hereby amended, and shall read as follows:

SECTION 2. Severability. If any sentence, clause or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any
other section, sentence, clause or phrase or work of this ordinance.
SECTION 3. Effective Date. This Ordinance shall take effect immediately after
passage if adopted by a majority plus one of the City Council, and this ordinance shall
thereby be designated as a public emergency ordinance necessary for the protection of the
public health, safety, property and welfare. Otherwise this ordinance shall take effect
and be in force five days after the date of its publication in the manner provided bylaw.
Publication of this ordinance shall be by summary thereof consisting of the title.
Adopted by the City Council of the City of Port Townsend, Washington, at a
regular meeting thereof, held this fourth day of August, 2008.
