RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PORT TOWNSEND GRANTING FINAL APPROVAL TO PHOENIX
ADDITION, PLAT ALTERATION NO. 1, APPLICATION LUP07-073
The City Council of the City of Port Townsend, Washington resolves as follows:
WHEREAS, Carol Wise & Anne McLaughlin, owners of Whirlwind H
L.L.C. and the subject property, have petitioned the City for final approval of a
plat alteration. The subject property contains portions of Blocks 6, 7 & 8 of the
Phoenix Addition to the City of Port Townsend, and is located east of Howard
Street between 24"' Sheet and unopened 25"` Street; and
WHEREAS, the original preliminary plat alteration application was submitted
in May, 2006 (LUP06-071) and consisted of 28 residential lots on approximately 4.59
acres. Preliminary approval for the plat alteration was granted by the City's Hearing
Examiner on November 30, 2006, subject to a number of conditions which included
the installation of streets, utilities, stormwater facilities and on-street landscaping to
serve the lots; and
WHEREAS, the Public Works Director has reviewed and approved the
construction plans for all required infrastructure. The infrastructure has been
installed and approved by city staff. The only remaining conditions include posting
of a financial security acceptable to the City for warranty of the improvements and
landscaping. With such measures in place, the final plat alteration request will be
in compliance with the conditions of the preliminary approval; and
WHEREAS, the Development Services Director has found that the final
plat alteration request is in conformance with the Hearing Examiner's decision on
the matter and complies with applicable environmental mitigation measures. The
final plat alteration is consistent with Chapter 18.16 of the PTMC and RCW
.58.17,215 (plat alterations); and
WHEREAS, the City Council has reviewed the proposal and concurs with
staff's recommendation,
NOW, THEREFORE, BE IT RESOLVED, the City Council hereby
GRANTS FINAL APPROVAL the Phoenix Addition, Plat Alteration No. 1, and
hereby directs staff to facilitate recording of the plat with the County Auditor,
subject to posting of the required warranty bond for the installed improvements.
