AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING
ORDINANCE 2953 TO CLARIFY THAT COMMERCIAL B UTILTTY RATE
APPLIES TO FORT WORDEN
WHEREAS, the City Council approves this Ordinance to remove a potential ambiguity
in utility rates set by Ordinance 2953 (adopted October 29, 2007). In adopting Ordinance 2953,
Council discussion and final action put Fort Worden under the "Commercial B" rates. This is
evident in the Minutes, as well as the Council agenda bill for the meeting. The agenda bill states
that: "At the September 10 Council meeting, Councilor Randels requested elimination of the
"Commercial B (over limit)" category (commercial users using over 800,000 gallons per month,
of which the only such single user/customer is Fort Wordenl." The minutes state "Fort Worden
is the only customer affected by this rate" (referring to the Commercial B rate). The FCS rate
study modeled rates with Fort Worden in Commercial B.
WHEREAS, the City Council, based on the above, and to avoid any ambiguity,
determines to amend Ordinance 2953 to explicitly place Ft. Worden in the Commercial B rate
(instead of the government rate).
NOW THEREFORE, the City Council of the City of Port Townsend ordains as follows:
Section 1. Amendment. Table Utility -Water Rates and Table Utility Rates -Sewer rates,
which are Exhibit A to Ordinance 2953 and Chapter 13.05 of the Port Townsend Municipal
Code, are amended as follows (underline is added, strike is deleted).

Section 2. Severability. If any provision of this ordinance or its application to any person or
circumstance is held invalid, the remainder of the ordinance, or the application of the provision
to other persons or circumstances is not affected.
Section 3. Effective Date. This ordinance shall take effect five days after its passage, approval
and publication in the form and manner provided by law.
Adopted by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this seventeenth day of March 2008.
