OS-009 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON, DECLARING PRINCETON SERVER GROUP THROUGH TELVUE VIRTUAL TELEVISION NETWORK (TVTN) AS THE SOLE SUPPLIER OF A DIGITAL TAPELESS SERVER AND NETWORK PACKAGE FOR OPERATION OF THE PTTV STATION, AND AUTHORIZING THE CITY MANAGER TO PURCHASE THE PACKAGE WHEREAS, State law and the City's own purchasing ordinance requires purchases of materials and supplies over $15,000 a year to be competitively bid, unless an exemption to competitive bidding applies; and WHEREAS, the PEG Access Coordinating Committee with outside consultation service (provided for free or nominal cost) reviewed over several months a number of systems and packages. The goal was to have a system that allows for a digital tapeless server and network for operation as a small TV station. The existing system, using a combination of tape and digital equipment, is outdated technology and prone to breakdown. It is essentially the same equipment purchased 10 years ago (with occasional, piecemeal upgrades when necessary). WHEREAS, the PEG Access Coordinating Committee recommends a new package that represents a significant upgrade. The package determined best suitable for the station was the one offered by Princeton Server Group though Te1Vue Virtual Television Network (TVTN). WHEREAS, the Princeton Server Group equipment package through Te1Vue is the sole source of the equipment because it alone meets the following necessary standards: 1. This is the only system that offers local support and service maintenance; 2. This is the only system with built-in redundancy; 3. This system offers four channels at the comparable price of two channel systems from other suppliers; 4. This system is the only one that offers remote programming capability; 5. This system is the only one that offers Unix-based, non-proprietary software; 6. This is the only system that constantly monitors the health of our equipment remotely (every 20 seconds), and can make most repairs remotely; 7. This is the only system that offers free maintenance of software during the life of our contract with them; 8. This is the only system that provides adrag-and-drop graphic user interface. WHEREAS, TelVue is the only distributor for the Princeton Server Group equipment package that meets the above standards; and WHEREAS, a competitive bidding process would likely only produce one bid; and WHEREAS, RCW 35.23.352(9) authorizes sole source purchasing without calling for bids; and ResoLudon 08-009 WHEREAS, RCW 39.04.280 allows competitive bidding to be waived in certain circumstances, including, where purchases are clearly and legitimately limited to a single source of supply. RCW 39.04.280 is applicable to code cites under 20,000 population like Port Townsend by RCW 35.23.352(9). NOW, THEREC+ORE, BE IT RESOLVED by the City Council of the City of Port Townsend: 1. As recommended by the PEG Access Coordinating Committee, the Princeton Server Group though TelVue Virtual Television Network (TVTN) is declared the sole source of the Princeton Server Group package. 2. The City Manager is authorized to execute necessary agreement and related documents for the purchase of the Princeton Server Group package though TelVue Virtual Television Network (TVTN) package, as recommend by the PEG Access Coordinating Committee. ADOPTED by the City Council of the City of Port Townsend at a regular meeting thereof, held this 19`s day of February 2008.
