HomeMy WebLinkAbout15-037 Rosecrans Terrace final Plat Approval PUD Resolution 15-037 Page 1 of 2 RESOLUTION NO. 15-037 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON, GRANTING FINAL PLAT APPROVAL TO THE ROSECRANS TERRACE PLANNED UNIT DEVELOPMENT,APPLICATION LUP15-028 WHEREAS, Mike Dunne, on behalf of CAFS, L.L.C., a Washington limited liability corporation, has petitioned the City for final approval of their Plat, Plat Alteration and Planned Unit Development (PUD) known as Rosecrans Terrace; and WHEREAS,the original preliminary Plat, Plat Alteration and PUD applications were submitted on or about October 5, 2004 (LUP04-122) and, as approved, sought to create 28 new residential lots from approximately 6 acres. The new lot configuration is achieved via the re-platting of 30 existing lots along with several sections of unopened street and/or alley rights-of-way lying within the Laurel Shade Addition to the City of Port Townsend; and, WHEREAS,the Port Townsend City Council granted preliminary approval to the Plat and Planned Unit Development(PUD), subject to certain clarifying conditions as set forth in their Findings, Conclusions and Order on Appeals from the Hearing Examiner dated October 23, 2006. In granting their preliminary approval, the Council overturned the Hearing Examiner's decision, and granted preliminary approval conditioned on a modification of the residential lot configuration to provide the project with additional open space and buffering provisions necessary for final PUD approval. Other than these modifications, Council accepted all other project conditions as recommended by staff to the City's Hearing Examiner. Following the exhaustion of judicial appeal .remedies by parties of record, the conditions of preliminary Plat, Plat Alteration and PUD approval were established; and, WHEREAS, the Public Works Director has previously reviewed and approved Applicant's construction plans for all required project infrastructure and found their installation to be in compliance with the approved plans (City File No. SDP14-030). So long as a security for the completed infrastructure improvements is established,the Public Works Director recommends Rosecrans Terrace be granted final approval and recorded with the Jefferson County Auditor; and WHEREAS,the Development Services Director has found that, aside from completion of three (3)remaining items, the Applicant's request is in conformance with Council's October 2006 Findings including all applicable environmental mitigation measures. The 3 remaining items include: establishment of a performance security for completion of the required landscaping; the completion of minor edits to the plat map required by City and/or County staff; and, finalization of a Planned Unit Development Agreement (PUDA) signed by both the applicant and the City. Upon completion of the above items, Rosecrans Terrace will be consistent with Chapters 17.32, 18.16 and 18.24 of the PTMC and recording of the final Plat and PUDA with the Jefferson County Auditor may occur. WHEREAS,the City Council has reviewed the proposal and concurs with staff's recommendation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port Townsend as follows: 1. The City Council APPROVES the Rosecrans Terrace Planned Unit Development and authorizes and directs staff to facilitate recording of the final Plat with the County Auditor, subject to posting of the required security bonds and the completion of any remaining edits to the face of the plat map. 2. The City Manager is authorized to sign the required Planned Unit Development Agreement on behalf of the city once the final draft has been reviewed and approved by the City Attorney in consultation with the Directors of Public Works and Development Services. ADOPTED by the City Council of the City of Port Townsend at a regular meeting thereof, held this 2nd day of November, 2015.
