HomeMy WebLinkAbout3134 Rescinding Fire Hazard Emergency Ordinance 3134 Page 1 of 2 Ordinance 3134 AN ORDINANCE OF THE CITY OF PORT TOWNSEND RELATED TO A FIRE HAZARD EMERGENCY; RESCINDING THE DECLARATION OF EMERGENCY RELATED TO FIRE HAZARDS AND AMENDING ORDINANCES 3131 AND 3132 RECITALS: A. On July 20, 2015, the City Council of the City of Port Townsend enacted Ordinance 3131. This Ordinance declared a water supply and fire hazard emergency. B. At the July 20 meeting, Council directed staff to revise the Drought Contingency Response Plan and to prepare a Fire Hazard Response Plan; C. On August 3, 2015, Council adopted a revised Drought Contingency Plan and a Fire Hazard Response Plan, and took other actions consistent with those plans. D. On September 18, 2015, the State Department of Natural Resources lifted its burn restrictions west of the Cascade Mountains. E. Effective October 1, 2015, East Jefferson Fire Rescue lifted the burn ban for Jefferson County. NOW, THEREFORE, the City Council of the City of Port Townsend do ordain as follows: Section 1. Continuation of Emergency. The City Council hereby declares that the emergency related to possible water shortages continues to exist. The emergency shall exist until Council takes action to remove. Section 2. Termination of Emergency related to Fire Hazards. Based on the determinations from the State Department of Natural Resources and the East Jefferson Fire Rescue, Council terminates the fire hazard emergency. a. Section 2 of Ordinance 3131 is amended to read as follows: Section 2. Declaration of Emergency. The City Council hereby declares an emergency related to enhan .,a�haza a=d,and possible water shortages. Council adopts the Drought Contingency Response Plan, attached as Exhibit D. Council directs the City Manager to revise the Response Plan to condense the response phases to a more aggressive timeline, and to submit a revised Response Plan as soon as practicable. Section 1 of Ordinance 3132 is amended to read as follows: Section 1. Continuation of Emergency. The City Council hereby declares that the emergency related to enhaneed fire hazard, and possible water shortages continues to exist. The emergency shall exist until Council takes action to remove. d. Sections 3, 4, and 5 of Ordinance 3132 are repealed; provided, that any abatement actions begun under the provisions of Ordinances 3131 and 3132 may continue, and contingency funds in account 102-000-510-41 may be used for those actions. Section 3. All other provisions of Ordinances 3131 and 3132 shall remain in effect. Section 4. Severability. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances, is not affected. Section 5. Effective Date. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law.
