RESOLUTION NO. 15-033
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, FIXING THE TIME FOR HEARING ON AN ORDINANCE
AUTHORIZING THE ACQUISITION OF REAL PROPERTY USING EMINENT
DOMAIN RELATED TO THE HOWARD STREET EXTENSION PROJECT
WHEREAS, the City Council passed Resolution 15-009 on January 20, 2015,
authorizing the City of Port Townsend to acquire certain real property for public use in the
construction and maintenance of the Howard Street Extension Project and directing the City
Manager or designee to engage the owner of the property in purchase and sale negotiations; and
WHEREAS, while City staff has successfully negotiated the acquisition of several of the
parcels, some of the purchase and sale negotiations have not yet been successful. The City
cannot, except at great expense and delay, revise its construction plans and designs for the
Howard Street Extension Project to eliminate the need to acquire some of the real property; and
WHEREAS, the City Council finds that the only available procedure for acquisition of
the required property may be by eminent domain and, while the City's preferred process is to
arrive at a negotiated sale, construction, bidding, and financing timelines may require the City to
acquire the property using eminent domain.
NOW,THEREFORE,BE IT RESOLVED, THAT:
The Port Townsend City Council shall conduct a public hearing on proposed Ordinance
Number 3133, which would authorize the acquisition of real property related to the Howard
Street Extension Project by eminent domain as provided for in Chapter 8.25 of the Revised Code
of Washington.
The hearing will be conducted at or about 6:30 PM on Monday, October 19, 2015, in the
Council Chambers of City Hall, 540 Water Street, Port Townsend, Washington or such other
date as the Mayor determines if necessary to accommodate other Council business.
ADOPTED by the City Council of the City of Port Townsend at a regular business
meeting thereof, held this 21 st day of September 2015.
