RESOLUTION 15-004
A RESOLUTION DECLARING AN EMERGENCY AND RATIFYING THE CITY
MANAGER'S APPROVAL OF ALL APPLICABLE DOCUMENTS TO ALLOW FOR THE
REPAIR OF THE BIG QUILCENE RIVER DIVERSION ROAD.
WHEREAS, Section 3.46.090 of the City of Port Townsend Municipal Code, and Section
39.04.280(1)(c) of the Revised Code of Washington allows exemptions to competitive bidding
requirements under emergency conditions; and
WHEREAS,as a result of rain and wind storm events on December 9-11, 2014, the access road
to the Big Quilcene River water diversion, in the Olympic National Forest incurred wash-out damage in
several locations. It is currently unsafe to drive to the water diversion. In addition, the transmission line
carrying water from the diversion is also located within this roadway. The length of the area affected
along forest service road NF 2700-040 is approximately 700 feet, spread out over seven separate
locations from milepost three to milepost four; and
WHEREAS,the City Manager has declared repairs to the road an emergent situation based on
the engineering reports and the and the onset of seasonal severe weather and high winds; and
WHEREAS,the city's municipal code requires City Council to concur with the City Manager's
declaration of emergency by passage of a resolution; and
WHEREAS,the City Council finds that it is in the best interest of the City to declare an
emergency and authorize the execution of all necessary documents to repair the road,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port Townsend
as follows:
Section 1. The City Council hereby declares an emergency justifying the waiver of certain
contracting processes.
Section 2. The City Manager's actions as set out in his Memorandum dated December 23, 2014,
are ratified and confirmed.
Section 3. The City Manager may take any additional administrative actions consistent with this
resolution.
ADOPTED by the City Council of the City of Port Town end at a regu ar meeting thereof, held
this 5th day of January, 2015.
