HomeMy WebLinkAbout14-046 Granting Final Plat Approval to Birkenfeld Community Planned Unit Development Resolution 14-046 Page I of 2 Resolution No. 14-046 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND GRANTING FINAL PLAT APPROVAL TO BIRKENFELD COMMUNITY PLANNED UNIT DEVELOPMENT, APPLICATION LUP14-044 The City Council of the City of Port Townsend, Washington resolves as follows: WHEREAS,Habitat for Humanity of East Jefferson County ("Habitat")has petitioned the City for final approval of the Birkenfeld Community Planned Unit Development(PUD), a low-income single-family residential subdivision located east of Hancock Street between 1 Ith and 12th Streets in the Castle Hill area of Port Townsend; and WHEREAS,the original preliminary PUD, Plat and Plat Alteration request for the Birkenfeld Community was submitted on or about April 22, 2013 (LUP13-031). As presented and approved, the project involves the creation of 12 ready-to-build residential lots and l dedicated play area parcel. The new lot and roadway configuration of Birkenfeld is achieved via the re-platting of 10 existing lots and a one-block section of unopened 1 lth Street right-of-way within the underlying Eisenbeis Addition. A new alternative circular right-of-way(Nora Porter Loop) is being dedicated and built as a one- way hardsurfaced road to serve the new lots from Hancock Street. The total site area (including the 11th Street right-of-way being vacated) is approximately 1.46 acres. The resulting 12 residential lots range in size from slightly over 3,000 to 6,315 square feet in size. The play lot, dubbed"Nora's Neighborhood", contains 5,833 square feet; and WHEREAS,the Birkenfeld Community PUD, Plat and Plat Alterations applications were granted preliminary approval, subject to certain conditions, by the City's Hearing Examiner on September 9, 2013; and WHEREAS, the Public Works Director has reviewed and approved construction plans for all required infrastructure and finds, with the exception of some minor stormwater facility grading work, their installation to be in compliance with the Hearing Examiner's decision. In regards to the remaining stormwater facility work, the Public Works Director is exploring an alternative to completing this work according to the approved plans which offers a preferable outcome for overall stormwater system reliability. The Public Works Director supports recording the final PUD and plat so long as the City is provided with"as-built"plans and conveyance documents for the project infrastructure completed to date, together with an appropriate means of ensuring the minimum stormwater grading work that remains to be completed is established; and WHEREAS,the Development Services Director has found that the final PUD, Plat and Plat Alteration request is in conformance with the Hearing Examiner's decision, complies with applicable environmental mitigation measures, has bonded for any outstanding physical requirements that remain unfulfilled, and includes appropriate measures for recording to title a Planned Unit Development Agreement(PUDA) signed Resolution 14-046 Page 2 of 2 by both the applicant and the city. Further, the final PUD, Plat and Plat Alteration approval for the Birkenfeld Community will be consistent with Chapters 17.32, 18.16 and 18.24 of the PTMC once minor corrections to the final plat map are completed; and WHEREAS,the City Council has reviewed the proposal and concurs with staff s recommendation. NOW,THEREFORE,BE IT RESOLVED,the City Council hereby APPROVES the Birkenfeld Community PUD and hereby directs staff to facilitate recording of the final Plat and all associated documents with the County Auditor once the any minor corrections are made to the final plat map, the "as-built" plans and conveyance documents for the project infrastructure completed to date are provided, and an appropriate means to ensure the minimum stormwater grading work that remains to be completed has been established. Furthermore,the City Manager is hereby authorized to sign the required PUDA on behalf of the city once the final draft has been reviewed and approved by the City Attorney in consultation with the Directors of Public Works and Development Services.
